Comment: The fact that some sections of this ordinance may need updating is of no detriment to <br />the good that it does in promoting the dignity, life and health of the person who call Lakewood <br />their home. Even if one section or another may not be enforceable, the rest of the ordinance is a <br />statement of great worth. <br />19. 503.99 PENALTY. <br />(a) Whoever violates <br />Section 503.02, 503.25, 503.26, 503.27, 503.28, 503.29, 503.30, 503.31, 503.32, 503.3 3, <br />503.34 or 503.35 is guilty of a misdemeanor of the first degree. <br />(b) Whoever violates any other provision of this chapter is guilty of a misdemeanor of the <br />third degree. <br />(c) Every day that any such violation continues shall constitute a separate and distinct <br />offense. <br />Comment: As a city ordinance, penalties are properly less than the same offenses under state <br />th <br />law, where similar offenses are typically 4degree felonies.
