Referred to Housing 9/16/19 <br />Anderson, Bullock, George, Litten, O'Leary, <br />RESOLUTION NO. 9093 -19 BY: O'Malley, Rader <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of at <br />least two thirds of the members of council, or otherwise to take effect at the earliest period allowed <br />by law, authorizing the Mayor or his designee to enter into an agreement with WXZ Residential <br />Group /Lakewood, LLC for an economic development grant, issued in the form a single rebate, for <br />a total amount not to exceed one hundred thousand dollars ($100,000.00), in order to assist the <br />grantee in preparing the site for residential development. <br />WHEREAS, WXZ Residential Group /Lakewood, LLC has purchased the property located <br />at 13900 Lake Avenue, PPN 312 -02 -011; and <br />WHEREAS, this property is the site of the formerly operating Marathon gas station which <br />has underground storage tanks and will require remediation; and <br />WHEREAS, WXZ Residential Group/Lakewood, LLC has requested assistance in order <br />to assist with underground storage tank removal and soil contamination remediation to return the <br />site to a usable state for residential development; and <br />WHEREAS, this assistance will be provided in the form of a single rebate issued after a <br />"No Further Action" letter is obtained from the EPA for the site; and <br />WHEREAS, this is an opportunity to help the property reach its highest and best use, to <br />assist the owner in restoring this site to accommodate a residential use; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments in that the grant agreement should be executed <br />immediately to allow improvements to the real property to begin; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor of Lakewood, or his designee, is hereby authorized to enter into an <br />agreement with WXZ Residential Group /Lakewood, LLC for an economic development grant in <br />an amount not to exceed One Hundred Thousand Dollars ($100,000.00) toward underground <br />storage tank removal, soil contamination remediation, and preparation of the site for residential <br />development at 13900 Lake Avenue, Lakewood, Ohio 44107; said agreement to contain such terms <br />
