4.03 An employee shall have the right to revoke such authorization by giving written notice to the <br />City and the Local Union Treasurer at anytime. Revocation of Union membership does nor revoke <br />union dues authorization, which may be revoked as set forth below. <br />Any voluntary dues checkoff authorization shall be irrevocable, regardless of whether an employee <br />has revoked Union membership, for a period of one (1) year from the date of the execution of the <br />dues checkoff authorization and for year to year thereafter, unless the employee gives employer and <br />the Union written notice of revocation not less than ten (10) days and not more than twenty-five (25) <br />days before the end of any yearly period. Copies of employees' dues checkoff authorization cards <br />are available from the Union upon request. <br />4.04 The City's obligation to make deduction shall terminate automatically upon termination of <br />employment or transfer to a job classification outside the bargaining unit. <br />4.05 The parties agree that the employer assumes no obligation, financial or otherwise, arising out <br />of the provisions of this Article regarding the deduction of union dues . The Union hereby agrees <br />that it will indemnify and hold the employer harmless from any claims, actions or proceedings by <br />any employee arising from deductions made by the employer pursuant to the Article, unless <br />specifically accepted above. <br />4.06 <br />4.07 Employees may authorize the City to deduct voluntary contributions to Public Employees <br />Organized to Promote Legislative Equality (PEOPLE) by payroll deductions (check -off). Upon <br />receipt of the employee's PEOPLE deduction authorization, the City shall make the deduction <br />and remit monthly to PEOPLE all such deducted contributions. PEOPLE contributions shall be <br />deducted and processed separately from dues or fair share deductions. <br />ARTICLE 5 MANAGEMENT RIGHTS <br />5.01 Except as specified otherwise in this Agreement, the City has the right and responsibility to: <br />1) determine matters of inherent managerial rights, which include, but are not limited to, areas of <br />discretion or policy such as the functions and programs of the City, standards or services, its overall <br />budget, utilization of technology and organization structure; 2) direct, supervise, evaluate and hire <br />employees; 3) maintain and improve the efficiency and effectiveness of the City's operations, <br />including the right to reorganize, discontinue, enlarge or contract any work; 4) manage the <br />operations and determine the overall methods, process, means or personnel by which the City's <br />operations are to be; 5) suspend, discipline or discharge for just cause; 6) layoff, transfer (including <br />the assignment and allocation of work) within departments or to other departments, assign, schedule, <br />promote or retain employees; 7) determine the adequacy of and direct the work force; 8) determine <br />the overall mission of the City as a unit of government and take actions to carry out that mission; 9) <br />effectively manage and direct the work force and operations; 10) control the premises and facilities, <br />and determine the number and location of facilities; 11) promulgate and enforce reasonable <br />employment rules and regulations; 12) introduce new and/or improved equipment, methods and/or <br />facilities; 13) determine the size, duties and work methods of the work force; 14) determine the <br />number of shifts required and work schedules;15) establish, modify, consolidate or abolish jobs (or <br />classifications); 16) determine the manner in which the work is to be processed or to be <br />
