ARTICLE 11 <br />PROBATIONARY PERIOD <br />11.01 New full-time employees shall be considered to be on probation for a period of ninety (90) <br />calendar days and during such probationary period, the City shall have sole discretion to discipline <br />or discharge such employees, and such actions during this period cannot be reviewed through the <br />grievance procedure. <br />11.02 If an employee is discharged or quits while on probation and is later rehired, the employee <br />shall be considered a new employee and subject to provisions of Section 1 of this Article. <br />11.03 Any City employee who works in a classification outside this bargaining unit shall be <br />considered a new employee when transferred to this bargaining unit, except those who are <br />currently members of an AFSCME bargaining unit. Any new employee in this bargaining unit <br />who has had previous employment with the City of Lakewood shall retain all credits due towards <br />longevity, vacation and sick leave accumulation. <br />ARTICLE 12 <br />SENIORITY <br />12.01 Seniority, for the purpose of layoff, shall be an employee's uninterrupted length of <br />continuous service with the City within a classification included in the bargaining unit. An <br />employee shall have no seniority during the probationary period provided in Article 11, but upon <br />completion of the probationary period, seniority shall be retroactive to the date of hire. <br />Management personnel shall not accumulate any seniority while employed outside the bargaining <br />unit. <br />12.02 Upon the request of a Chapter Officer, but not more than twice a year, the City shall provide <br />the Union with a copy of the seniority lists and these lists shall be updated every six (6) months. <br />The seniority lists shall contain, in order of seniority, the name, division, classification and date of <br />hire for each employee. The City also shall provide a second list in alphabetical order containing <br />the employee's name, address, and telephone number. Seniority shall be broken when an <br />employee: <br />Quits or resigns. <br />2. Is discharged for just and proper cause. <br />3. Is laid off for a period of more than twenty-four (24) consecutive months. <br />4. Fails to report to work when recalled from layoff within five (5) calendar days from <br />the date on which the certified mail is received by the employee. The City will send the <br />employee notice by certified mail (to the employee's last known address as shown on <br />the City's records). <br />
