Enerlogics, however there is a state-imposed cap on how much extra power can be produced. Mr.
Wise indicated that generally a system needs to be sized to ensure that there is no extra energy at
the end of the year. Councilman Bullock highlighted differences between residential and
commercial solar uses to give examples of how one could be assessed fees for overproduction of
energy due to monopolies that have been carved out by utility companies.
Mr. Wise stated that if there is a major roof problem after installation of the solar panels and the
city cannot make a fix in a short period of time, forcing it to take the system down, it will have to
pay for what the system would have produced. In the event of an act of God, bother parties must
make reasonable actions to repair, however there are several exceptions on both sides. The city
has to option to tell Enerlogics to take the system offline for 48 daylight hours during each year
for maintenance and repairs, which would equal about 4-5 days. Director Beno stated that Public
Works will make sure the roofs are in good shape prior to the panels being installed on them.
There is about$200,000 of work to do before they go on. Councilman Bullock noted that with
this piece of legislation, City Council is authorizing the mayor to sign the purchase agreement.
Councilman Bullock made a motion to recommend adoption of Resolution 2019-01 by full
Council, which was seconded by Chairman Rader.
Assistant Director Swallow noted that the final adjustments needed to the legislation is to figure
out the insurance component and add in an indemnification for public records. If the resolution
was adopted that night, it would need to be in the form of a substitute version. Pre-construction
videos will be taken of the roofs where the panels will be placed.
Councilman Bullock made a motion to recommend adoption of Resolution 2019-01 by full
Council with substitute exhibit, which was seconded by Chairman Rader. All members voted in
favor. Motion passed.
The meeting was adjourned at 6:11 p.m.
