RESOLUTION NO. 2020-38 <br />Substitute for Res. No. 2020-38. <br />Bullock, Kepple, Litten, Neff, O'Malley, Rader, <br />BY: Shachner <br />A RESOLUTION to take effect immediately provided it receives the vote of at least two thirds of <br />the members of Council, or otherwise to take effect at the earliest period allowed by law, affirming that all <br />funds received from the County Coronavirus Relief Distribution Fund pursuant to H.B. 481 be expended <br />only to cover costs of the City of Lakewood consistent with the requirements of section 5001 of the CARES <br />Act as described in 42 U.S.C. 601(d), and any applicable regulations and guidance. <br />WHEREAS, the Coronavirus Aid, Relief, and Economic Security Act, 116 Public Law 136, (the <br />CARES Act) was signed into law by the President of the United States on March 27, 2020; and <br />WHEREAS, the Ohio General Assembly established a process for distributing funds provided by <br />the "Coronavirus Aid, Relief, and Economic Security Act" in House Bill 481 of the 133rd General <br />Assembly (H.B. 481); and <br />WHEREAS, H.B. 481 requires subdivisions receiving funds under Section 1 of the act, to pass a <br />resolution affirming that funds from the County Coronavirus Relief Distribution Fund may be expended <br />only to cover costs of the subdivision consistent with the requirements of section 5001 of the CARES Act <br />as described in 42 U.S.C. 601(d), and any applicable regulations before receiving said funds; and <br />WHEREAS, Lakewood is requesting its share of funds from the County Coronavirus Relief <br />Distribution Fund; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, <br />this Council by a vote of at least two thirds of its members determines that this resolution is an emergency <br />measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of <br />the public property, health, and safety and to provide for the usual daily operation of municipal departments <br />in that the State of Ohio is under an order of a state of emergency from the Governor and has incurred <br />additional expenses and financial losses as a result of the COVED-19 pandemic; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Lakewood affirms that all funds received from the County Coronavirus Relief <br />Distribution Fund pursuant to H.B. 481 be expended only to cover costs of the subdivision consistent with <br />the requirements of section 5001 of the CARES Act as described in 42 U.S.C. 601(d), and any applicable <br />regulations and guidance only to cover expenses that: <br />(a) Are necessary expenditures incurred due to the public health emergency with respect to the <br />Coronavirus Disease 2019 (COVI-19); <br />(b) Were not accounted for in Lakewood's most recently approved budget as of March 27, 2020; and <br />(c) Were incurred during the period that begins on March 1, 2020, and ends on December 30, 2020. <br />Section 2. The Director of Finance, in compliance with H.B. 481, shall take all necessary action to: <br />
