Please substitute for the original ORDINANCE NO. 19-2020 BY: Bullock, Kepple, Litten, Neff,, O'Malley, Rader, Shachner AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, authorizing the Mayor to enter into an lease agreement with Trinity Project LLC for Trinity Lutheran Church, pursuant to Section 155.08 of the Codified Or- dinances, to allow application for historic tax credit for the property. WHEREAS, the City is the owner of real property located in Lakewood, Ohio, known as Trinity Church, PPNs 311-3 0-03 0, 311-3 0-029 and 311-3 0-028; and WHEREAS, Lakewood had entered into a development agreement with Scalish Con- struction Inc. for the former Trinity Lutheran Church site; and WHEREAS Scalish Construction, Inc./Trinity Project LLC would like to seek historical tax credits as part of the development of the property and must have title to or a lease for the property in order to do so; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this ordi- nance is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments, in that the application for historic tax credit must be submitted by September 29, 2020 in order to be considered for December, 2020 award, there- fore, •' �� - + •. ii� • • Section 1. The Mayor is hereby authorized, on behalf of the City, to enter into a lease agreement with Trinity Project LLC for the former Trinity Lutheran Church property (PPNs 311- 3-030, 311-30-029 and 311-30-028), pursuant to Section 155.08 of the Codified Ordinances, to be on terms approved by the Director of Law and in substantially the same form as the document attached as Exhibit A. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 3. This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmative vote of at least two thirds of the mem-
