Please substitute for the original <br />ORDINANCE NO. 19-2020 BY: Bullock, Kepple, Litten, Neff,, <br />O'Malley, Rader, Shachner <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force after the <br />earliest period allowed by law, authorizing the Mayor to enter into an lease agreement with <br />Trinity Project LLC for Trinity Lutheran Church, pursuant to Section 155.08 of the Codified Or- <br />dinances, to allow application for historic tax credit for the property. <br />WHEREAS, the City is the owner of real property located in Lakewood, Ohio, known as <br />Trinity Church, PPNs 311-3 0-03 0, 311-3 0-029 and 311-3 0-028; and <br />WHEREAS, Lakewood had entered into a development agreement with Scalish Con- <br />struction Inc. for the former Trinity Lutheran Church site; and <br />WHEREAS Scalish Construction, Inc./Trinity Project LLC would like to seek historical <br />tax credits as part of the development of the property and must have title to or a lease for the <br />property in order to do so; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this ordi- <br />nance is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments, in that the application for historic tax credit must <br />be submitted by September 29, 2020 in order to be considered for December, 2020 award, there- <br />fore, <br />•' �� - + •. ii� • • <br />Section 1. The Mayor is hereby authorized, on behalf of the City, to enter into a lease <br />agreement with Trinity Project LLC for the former Trinity Lutheran Church property (PPNs 311- <br />3-030, 311-30-029 and 311-30-028), pursuant to Section 155.08 of the Codified Ordinances, to <br />be on terms approved by the Director of Law and in substantially the same form as the document <br />attached as Exhibit A. <br />Section 2. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />Section 3. This ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the preamble <br />to this ordinance, and provided it receives the affirmative vote of at least two thirds of the mem- <br />
