Referred to Public Works & <br />Sustainability 10/5/20 <br />RESOLUTION NO. 2020-64 BY: Bullock, Kepple, Litten, <br />Neff, O'Malley, Rader <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of at <br />least two thirds of the members of council, or otherwise to take effect at the earliest period allowed <br />by law, authorizing the Mayor of the City of Lakewood, or her designee, to prepare and submit an <br />application to participate in the Ohio Public Works Commission State Capital Improvement <br />Program, Local Transportation Improvement Program or any other appropriate Ohio Public Works <br />Commission program that the 2022 Watermain Replacement Pro j ect qualifies for and to execute <br />contracts as required. <br />WHEREAS, both the State Capital Improvement Program and the Local Transportation <br />Improvement Program provide financial assistance to political subdivisions for capital <br />improvements to public infrastructure; and <br />WHEREAS, the City of Lakewood is planning a sewer improvement project for 2022 which <br />includes portions of Andrews Avenue (Detroit to Clifton) and Gladys Avenue (Detroit to Clifton); <br />and <br />WHEREAS, the infrastructure improvements described above are considered to be a priority <br />need for the community and are qualified projects under the OPWC programs; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self-government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, because the OPWC <br />application deadline is November 5, 2020; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor of the City of Lakewood, or her designee, is hereby authorized to <br />prepare and submit an application to participate in the Ohio Public Works Commission State <br />Capital Improvement Program, Local Transportation Improvement Program, or any other Ohio <br />Pubic Works Commission funding program for which the projects identified in the preamble <br />qualify. <br />Section 2. The Mayor, the Director of Public Works, Director of Law and the Director of <br />Finance for the City of Lakewood are authorized to enter into any agreements as may be necessary <br />and appropriate for obtaining this financial assistance. <br />
