Director Corrigan noted that an investigation has not yet been complete in regard to this <br /> permit and requested a continuance. <br /> President O'Malley made a motion, seconded by Vice President Litten to defer the permit <br /> notice. <br /> A roll call vote was taken as follows: <br /> Yeas —Bullock, Kepple, Litten, Neff, O'Malley, Rader, Shachner <br /> Nays —None <br /> Motion passed. The permit notice was deferred. <br /> ***PUBLIC COMMENT"" <br /> Dana McSwain— 1347 Webb Rd—Ms. McSwain addressed Council regarding harassment, <br /> menacing and stalking that she is experiencing from her next-door neighbor. The neighbor <br /> has a history of assault. She described her discussions with the police and the Law <br /> Department and expressed frustration that she was advised to wait until the behavior <br /> escalates to a criminal level. She asked Council to take action to provide more protection to <br /> her and others facing similar problems. She acknowledged that stalking is a challenge for the <br /> criminal justice system and provided additional resources and information about stalking. <br /> She spoke about stalking's effects on its victims. She also asked Council and the Mayor to <br /> review the bodycam footage themselves. She said that she is preparing to move in the spring <br /> to remedy the situation. <br /> Chief Kaucheck replied that the Department is aware of the situation but that the behavior <br /> has not yet risen to a criminal level and that much of it is protected by the first amendment. <br /> Mayor George emphasized that her administration takes this matter seriously and regretted <br /> that stalking is difficult to prosecute. She read an email from the Assistant Prosecutor into the <br /> record(attached). <br /> Several councilmembers expressed a desire to help Ms. McSwain and others in these <br /> situations possible solutions included advocating for better statewide laws,providing training <br /> on stalking to city police and employees, discussing the issue in committee and reviewing the <br /> current laws. <br /> Director Corrigan assured Council that police and Law have met on this several times and are <br /> trying to resolve it but that having the evidence is important and any arrest being made must <br /> be legal. <br /> Brian Chambers — 1222 Manor Park Ave. - Mr. Chambers spoke regarding Council's passed <br /> resolution condemning the Capitol Riots. He stated his opposition to the resolution, and <br /> added he believed it to be full of mischaracterizations and divisive. <br />
