In the March 2019 IWWIP Phase 2 Plan, Mr. McMahon directed Council to Chapter 10, which is <br /> the actual plan adopted by Council. The remainder of the document contains background <br /> information and discussion. <br /> Mr. McMahon emphasized that the Lakewood system is truly unique in that is was built as <br /> several independent projects discharging straight to the Lake or Rocky River. Lakewood's <br /> sewers were not originally built as a system and our sewers are different street by street. <br /> Fortunately, the EPA has recognized that Lakewood's system is so unique within the region and <br /> the country. <br /> US EPA Update <br /> Mr. McMahon provided an update on the City's recent progress meeting IWWIP goals and <br /> objectives. Specific projects discussed included: <br /> • The new High-Rate Treatment Plant on track to open in 2022. The plant will increase the <br /> City's rate of captured and treated water from 85% to 88%. <br /> • 2016 aerial sewer project which eliminated 2.5 million gallons of CSO to Rocky River. <br /> • Atkins Ave pilot study of 103 properties with report to be released soon <br /> • Lake Ave resurfacing and water main replacement <br /> Mr. McMahon discussed how each project has reduced CSO events. He explained that all <br /> communities have a baseline obligation to eliminate 100% of CSO events unless they can <br /> demonstrate that 100% is technically and/or economically unfeasible. Because Lakewood <br /> connects to recreations water bodies, we are held to high standards. <br /> Mr. McMahon stated that the City is on track to remove 95% of pollutants within the next two <br /> permit cycles by investing an additional $50 million. He added that the City has the engineering <br /> work to prove that this is the best the City can do technically at two specific CSOs. <br /> President O'Malley asked for assurance that other lakefront communities were being held to the <br /> same standards and making similar investments. Mr. McMahon expressed confidence that other <br /> lakefront communities are making similar investments and provided examples. He added that our <br /> investments will directly benefit the City residents who live so close to the waters. <br /> Councilmember Bullock asked questions about the Atkins Ave. pilot study noting that the study <br /> has taken longer than expected to yield results. Mr. McMahon acknowledged that it was time- <br /> intensive to coordinate the work with all 103 households and to gather the post-construction <br /> monitoring. A report on the results will be released shortly. <br /> Mr. McMahon emphasized that all of the City's work has been done without a consent decree <br /> and the City has worked to demonstrate its ability to do so on its own without one. However, the <br /> EPA is still looking closely at Lakewood and has its own policies in place as to when and under <br /> what conditions a consent decree is warranted. In 2018 the EPA sent the City a draft consent <br /> decree and it may do the same again. Any updates to that effect will be brought before Council. <br /> Mr. McMahon noted that there are some protections and benefits from a consent decree such as <br /> protecting the City from citizen lawsuits. <br /> 2 <br />
