Referred to PWS 3/1/21 <br />Please substitute for the original <br />Please Substitutefor Original <br />Bullock, Kepple, Litten, Neff, O'Malley, Rader, <br />RESOLUTION NO. 2021-10 BY:.,Shachner <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest pe- <br />riod allowed by law, authorizing and directing the Mayor to enter into an agreement with Cleve- <br />land Metroparks for the construction and maintenance of the Detroit Connector Trail, an all- <br />purpose trail, and accepting funds in the amount of $25,000.00 toward the project construction <br />costs. <br />WHEREAS, Lakewood is the owner of the public right-of-way of Detroit Avenue in <br />Lakewood which is contiguous to the Cleveland Metroparks; and <br />WHEREAS, Lakewood is constructing an all-purpose trail within the public right-of-way <br />that will connect to an existing all-purpose trail owned and managed by the Cleveland Metro - <br />parks in the Rocky River Reservation; and <br />WHEREAS, Lakewood wishes to accept funds to assist in the construction of the all- <br />purpose trail and to rely on the Cleveland Metroparks for the ongoing maintenance of the all- <br />purpose trail; and <br />WHER.A.S, this Council by a vote of at least five of its members determines that this reso- <br />lution is an emergency measure, and that this resolution shall take effect at the earliest date pos- <br />sible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of <br />Lakewood, and that it is necessary for the immediate preservation of the public property, health <br />and safety, and to provide for the usual daily operation of municipal department in that the ac- <br />ceptance of these funds and maintenance agreement are necessary for the construction of the De- <br />troit Connector Trail; -now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor is hereby authorized, on behalf of the City, to enter into an agree- <br />ment with the Cleveland Metroparks to accept funds in the amount of $25,000 and for the ongo- <br />ing maintenance of the Detroit Connector Trail as approved by the Director of Law and in sub- <br />stantially the same form as the document attached as Exhibit A. <br />Section 2. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />Section 3. This resolution is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the preamble <br />to this resolution, and provided it receives the affirmative vote of at least five members of Coun- <br />
