Referred to Public Safety 5/3/21 <br />Bullock, Kepple, Litten, Neff, <br />RESOLUTION NO. 2020-39A BY: Of Malley, Rader, Shachner <br />A RESOLUTION to take effect immediately provided it receives the vote of at least <br />two thirds of the members of Council, or otherwise to take effect at the earliest period allowed <br />by law, to amend Resolution 2020-39, adopted August 3, 2020 in order to extend the curbside <br />express parking program. <br />WHEREAS, Council authorized a curbside express parking program in August 2020 in <br />response to the disruption of normal business practices caused by the COVID- 19 pandemic; <br />and, <br />WHEREAS, the express parking program is set to expire upon the ending of the <br />COVID- 19 pandemic; and, <br />WHEREAS, the impact of the pandemic on people's behaviors and expectations of <br />retailers may be long-lasting; and, <br />VvTFMREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to <br />provide for the usual daily operation of municipal departments in that Lakewood retailers <br />need consistency and predictability while it remains unknown when the pandemic will come to a <br />true end; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. That Resolution 2020-39, adoptedAugust 3,2020, cuaenflyreading as follows: <br />Section 1. The Director of Public Safety, upon consultation with the Police Chief, Fire <br />Chief, Public Works Director, and Planning & Development Director, is authorized and <br />directed to designate express parking spaces under the following circumstances: <br />1. In support of businesses located along a commercial corridor with no <br />access to or use of a private parking lot, or those for which the use of a <br />private parking lot would impart reasonable difficulty or an undue safety <br />risk to the employees in the operation of the private express parking <br />space. <br />2. All designated express parking spaces will be established for the benefit of <br />multiple businesses, not a single business. <br />3. Express parking is limited to one public parking space within the block <br />(i.e., one space on each side of the street between cross street <br />intersections). The Director of Public Safety shall have the discretion to <br />designate additional express parking spaces where there is need based on <br />actual use of the existing designated express parking space. <br />4. Designation of express parking will be valid through the duration of the <br />COVIID-19 public health emergency as ordered by the State of Ohio. <br />5. The Director of Public Safety shall have discretion in the administration <br />of this Resolution to balance the benefit to Lakewood businesses while <br />ensuring parking is safe and readily available for use by the general <br />public. <br />Section 2.... <br />
