<br />Prohibited Uses
<br />The following restrictions shall be placed upon the Development Site and no portion of the Project
<br />shall be used for the following purposes or uses (collectively, the "Restricted Uses"):
<br />1. Any establishment which stocks, displays, sells, rents, distributes, or offers for sale or rent
<br />any x-rated, pornographic, lewd, obscene or so-called "adult" newspaper, book, magazine,
<br />film, picture, video tape, video disc, material or other similar representation or merchandise
<br />of any kind; Notwithstanding anything to the contrary, the City understands and agrees that
<br />Developer's business focuses on the LBGTQ+ community, including, without limitation,
<br />LB GTQ+ rights, fashion and entertainment, which may include, without limitation,
<br />burlesque, leather goods, kink and drag, and none of the foregoing shall be deemed to violate
<br />this or any other prohibited use, provided same is not pornographic or obscene under
<br />applicable laws.
<br />2. Any establishment which stocks, displays, sells, rents, distributes, or offers for sale or rent
<br />any tobacco products (including but not limited to hookah or "vaping" products) or
<br />paraphernalia commonly used in the use or ingestion of marijuana or illicit drugs; or any
<br />merchandise or material commonly used or intended for use with or in consumption of any
<br />narcotic, dangerous drug or other controlled substance, including without limitation, any
<br />hashish pipe, waterpipe, bong, pipe screens, rolling papers, rolling devices, coke spoons or
<br />roach clips. This restriction shall not prohibit the inclusion of a medical marijuana
<br />dispensary.
<br />3. Any "second-hand" store whose business is selling used merchandise such as thrift shops,
<br />salvation army type stores, "goodwill" type stores, and similar businesses. This restriction
<br />shall not prohibit regional or national brand name businesses (e.g. Gap's Old Navy) from
<br />selling quality used clothing and related merchandise which do not accept free donations of
<br />goods for resale. Notwithstanding the foregoing, Developer may have one (1) "second-hand"
<br />or thrift store such as, without limitation, Margie's Closet, and any additional "second-hand"
<br />or thrift store shall require the City's approval.
<br />4. Any slaughterhouse.
<br />5. Any mobile home park, trailer court, labor camp, junk yard, or stock yard (except that this
<br />provision shall not prohibit the temporary use of construction trailers during any periods of
<br />construction, reconstruction or maintenance).
<br />6. Any car wash.
<br />7. Any business selling gasoline or diesel fuel unless such fuel is never stored, maintained, or
<br />delivered on site.
<br />8. Any "adult" entertainment or any operation selling or displaying any nudity (including but
<br />not limited to partially clothed dancers or wait staff) or any establishment where the overt
<br />sexual allure of naked or scantily dressed persons is an important component of the goods or
