Councilmember Shachner asked whether the impervious fee legislation could still pass without <br /> adoption of the $25 million ARPA commitment. Director Corrigan stated that one piece could <br /> pass without the other. City Planner Milius added that the impervious fee legislation would have <br /> to be amended if the $25 million legislation did not pass, as the amount was written into it. <br /> Councilmember Neff asked whether there would be potential for higher rates than inflation <br /> without the $25 million commitment. Mr. McMahon explored the possibility and gave examples <br /> of other communities fighting the EPA in federal court over mandated expenditures on sewer <br /> systems. The ARPA has defeated their arguments that they have no money on hand to address <br /> sewer maintenance issues. Mr. McMahon also spoke to the importance of the narrative of <br /> progress when it comes to dealing with the EPA, something that Lakewood has demonstrated <br /> thus far. <br /> Co-Chair Bullock made a motion, seconded by Co-Chair Rader to defer Ordinance 24-2021 to <br /> the next committee meeting. All in favor. Motion passed. <br /> RESOLUTION 2021-33 -A RESOLUTION to take effect immediately provided it receives <br /> the affirmative vote of at least two thirds of the members of Council, or otherwise to take <br /> effect and be in force after the earliest period allowed by law, authorizing the Mayor <br /> and/or Director of Finance or Director of Law to allocate Twenty-Five Million Dollars <br /> ($25,000,000) to effectuate the modernization and construction of the City of Lakewood's <br /> sewer system with such funds allocated from the American Rescue Plan ("ARP") and <br /> Coronavirus State and Local Fiscal Recovery Funds ("CSLFRF"). (Referred to Finance <br /> Committee 6/21/21) <br /> Co-Chair Bullock inquired about the mechanics of allocating $25 million, despite not having the <br /> full amount in hand. The administration explained that Council is authorizing the use of the <br /> funds and not appropriating the actual money, which is still in the process of collection. Council <br /> can authorize the use of funds as long as it comes under the total $43 million that was award to <br /> the city of Lakewood via ARPA. <br /> Co-Chair Bullock made a motion, seconded by Councilmember Litten to defer Resolution 2021- <br /> 33 to the next committee meeting. All in favor. Motion passed. <br /> RESOLUTION 2021-26 -A RESOLUTION to take effect immediately provided it receives <br /> the affirmative vote of at least two thirds of the members of Council, or otherwise to take <br /> effect and be in force after the earliest period allowed by law, accepting the amounts and <br /> rates as determined by the Budget Commission and authorizing the necessary tax levies <br /> and certifying them to the County Fiscal Officer. (Referred to Finance 6/7/21) <br /> Co-Chair Bullock made a motion, seconded by Councilmember Litten to refer Resolution 2021- <br /> 26 to the full Council with no recommendation. All in favor.
