Placed on 1st reading & <br />referred to HPD 10/4/21; <br />2nd reading 10/18/21 <br />Bullock, Kepple, Li.tten, Nef ', <br />ORDINANCE NO.34-2021 BY O'Malley, Rader, Shachner <br />AN ORDINANCE to take effect January 1, 2022 to amend Section 903.09 Sidewalk Permit <br />to update fees charged for issuing of a sidewalk permit and inspection. <br />WHEREAS, the fee for a sidewalk permit is currently $25.00; <br />WHEREAS, multiple Lakewood employees touch the sidewalk permit process in either <br />issuing the permit or inspecting forms and the sidewalks after they are poured; <br />WHEREAS,$25.00 is not sufficient to cover the cost of employee time associated with the <br />issuance of a permit and the subsequent inspections; <br />WHEREAS, Lakewood should increase the fee for a sidewalk permit to reflect its actual <br />costs associated with the permit; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Effective January 1, 2022, Section 903.09 Sidewalk Permit of the Codified <br />Ordinances of the City of Lakewood, currently reading as follows: <br />903.09 SIDEWALK PERMIT. <br />(a) For the propose of this section, "sidewalk" means that portion of a street between the curb <br />lines, or the lateral lines of a roadway, and the adjacent property lines, intended for the use of <br />pedestrians. <br />(b) No person shall break, deface, damage or destroy any sidewalks or curbing in or along the <br />streets or public places of the City. <br />(c) Before any person, other than a City contractor, officer or employee, shall make any opening <br />or remove any sidewalk or curb in or along any of the streets, alleys, avenues or public grounds in <br />the City, such person shall file with the Director of Public Works a written or printed application <br />for a permit, setting forth and indicating thereon the location and extent of the opening in the <br />sidewalk or curb desired to be opened up or removed, and the purpose and size of the opening to be <br />made. Before any permit is granted, the applicant shall pay to the City a permit fee of twenty-five <br />dollars ($25.00) per address, after which payment the Director of Public Works may issue a permit, <br />and the applicant may proceed to do the work. The foregoing shall not apply to sidewalks taken up <br />to lay connections by persons duly authorized and required to make house connections, and to re- <br />lay and replace pavements under their contract. <br />(d) Nothing in this section is intended to supersede the provisions of Chapter 904. To the extent <br />any part of this section conflicts with Chapter 904, Chapter 904 shall control over the conflicting <br />part of this section. <br />is hereby repealed. <br />
