Referred to PWS 9/7/21 <br />Bullock, Kepple, Litten, Neff, <br />RESOLUTION NO.2021-41 O'Malley, Rader, Shachner <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force after <br />the earliest period allowed by law, authorizing the Lakewood City Engineer to prepare and <br />submit an application to participate in the Ohio Public Works Commission State Capital <br />Improvement and/or Local Transportation Improvement Program(s) and to execute contracts as <br />required. <br />WHEREAS, the State Capital Improvement Program and the Local Transportation <br />Improvement Program both provide financial assistance to political subdivisions for capital <br />improvements to public infrastructure, and <br />WHEREAS, the City of Lakewood is planning to make capital improvements for two (2) <br />projects: 2023 Watermain Replacement and Lakewood Interceptor Tunnel Rehabilitation, and <br />WHEREAS, the infrastructure improvements herein above described is considered to be <br />a priority need for the community and is a qualified project under the OPWC programs, <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments in that this submerged lands lease is <br />necessary for the improvements to be made; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1: The Lakewood City Engineer is hereby authorized to apply to the OPWC for <br />funds as described above. <br />Section 2: The Lakewood Mayor is authorized to enter into any agreements as may be <br />necessary and appropriate for obtaining this financial assistance. <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this Resolution were passed in open meetings of this Council and <br />that all deliberations of this Council and any of its committees that resulted in such actions were <br />in meetings open to the public and in compliance with legal requirements. <br />Section 4. This resolution is hereby declared to be an emergency measure neces-sary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the preamble <br />to this ordinance, and provided it receives the affirmative vote of at least two thirds of the <br />members of Council, this resolution shall take effect and be in force immediately upon its <br />adoption by the Council and approval by the Mayor, or otherwise it shall take effect and be in <br />force after the earliest period allowed by law. <br />
