MINUTES OF THE PUBLIC WORKS & SUSTAINABILITY COMMITTEE <br /> December 13, 2021 <br /> Online Broadcast Meeting <br /> Present: Councilmembers Rader, Shachner & Bullock <br /> Also Present: Director Leininger, City Planner David Baas, Deputy Clerk Lascu <br /> Start time: 5:15 p.m. <br /> AGENDA <br /> Approval of the minutes of the Public Works & Sustainability Committee held <br /> November 29, 2021. <br /> Motion by Chairman Rader, seconded by Councilmember Shachner to approve the minutes from <br /> the committee's November 29h meeting. All members in favor. Motion passed. The minutes <br /> were approved. <br /> ORDINANCE 33-2021 -AN ORDINANCE to take effect immediately provided it <br /> receives the affirmative vote of at least two thirds of the members of Council to <br /> create Chapter 357 Electric Vehicle Charging Stations within the Lakewood <br /> Codified Ordinances. (1st read and referred to PWS 10/4/21; 2"d reading 10/18/21) <br /> Director Leininger provided an overview of Ordinance 33-2021 using previously provided slides, <br /> noting that the committee had left questions with the administration at its last meeting. <br /> City Planner David Baas stated that the ordinance was based on Section 355 of the LCO, which <br /> governs parking meters. The use of that structure for the ordinance lends itself well because the <br /> organization around parking enforcement is already in place. The ordinance provides the basic <br /> authority for the Director of Public Safety to establish spaces and enforce ticketing if someone <br /> occupies the spot without charging. Section 357.03 provides basic control and maintenance of <br /> the spots to the Director of Public Works. Mr. Baas continued to review all components of the <br /> ordinance, and also highlighted the importance of an idle fee. <br /> Chairman Rader questioned whether the ordinance that the committee was reviewing was the <br /> one that was also on the docket. <br /> The committee clarified that a parking ticket would be assessed in the event some was not <br /> charging while parked in a charging spot and an idle fee would be charged for continuing to <br /> occupy the spot after being fully charged. These fees could be managed and assessed either <br /> through software or the charging station itself. <br /> The committee and Planning Department staff concluded that there was a typographical error in <br /> the ordinance and that Section 355.04 in the text should be changed to 357.04. <br />
