1306.28 WATER HEATING FACILITIES. <br />Every dwelling unit and occupiable structure when required by ordinance, shall have <br />supplied water heating facilities which are installed in a proper and approved manner, are <br />maintained in a safe and good working condition, are properly connected to the hot water lines <br />required by this Code and are capable of heating water to such temperature as to permit an adequate <br />amount of water to be drawn at every kitchen sink, lavatory basin, at a temperature of not less than <br />one hundred ten degrees (110°) at the shower and bathtub. Temperatures are not to exceed one <br />hundred twenty degrees (120°) Fahrenheit at the shower and bathtub if able to be adjusted within <br />the fixture valve, and one hundred forty degrees (140°) Fahrenheit under normal use. Such <br />supplied water heating facilities shall be capable of meeting the requirements of this section when <br />the dwelling, dwelling unit or occupiable structure heating facilities are not in operation. <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance with all legal requirements. <br />Section 4. This ordinance is hereby declared to be an emergency measure necessary for the <br />immediate preservation of the public peace, property, health, safety and welfare in the City and for <br />the usual daily operation of the City for the reasons set forth and defined in the preamble to this <br />resolution, and provided it receives the affirmative vote of at least two thirds of the members of <br />Council, this ordinance shall take effect and be in force immediately upon adoption by the Council <br />and approval by the Mayor, or otherwise it shall take effect and be in force after the earliest period <br />allowed by law. <br />Adopted 31 �1 �q-x <br />niel J.
