Placed on 1st reading & <br />referred to Public Safety <br />3/7/22; 2nd reading 3/21/22 <br />Baker, Bullock, Kepple, Litten, <br />0 <br />ORDINANCE NO. 14-2022 BY:' Malley, Rader, Shachner <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council repealing Section 549.19 Pocket Knives, of the <br />Lakewood Codified Ordinances. <br />WHEREAS, the State legislature has removed the prohibition of carrying knives that are <br />not actively used as a weapon; and <br />WHEREAS, Section 549.19 Pocket Knives, of the Lakewood Codified Ordinances is in <br />direct conflict with this change; and <br />WHEREAS, in order to be compliant with State law, it is necessary to repeal Section <br />549.19 Pocket Knives; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure and that it shall take effect immediately and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments in that Lakewood cannot legally enforce Section <br />549.19, Pocket Knives; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. That Section 549.19 Pocket Knives, of the Lakewood Codified Ordinances <br />reading as follows: <br />549.19 POCKET KNIVES. <br />(a) No person, firm or corporation shall give or sell to a minor any pocket knife <br />having a blade two and one-half inches or longer in length, or shall carry on or about his <br />person nay pocket knife having a blade two and one-half inches or longer in <br />length. However, any person charged with unlawfully carrying on such knife shall be <br />acquitted if it shall be proved at the trial that such person was at the time engaged in lawful <br />employment or occupation which is justified possession of such instrument or that <br />circumstances were such as to justify a prudent person to possess such instrument for <br />defense of his person, family or property. <br />(b) No person shall give away or sell a pocket knife having a blade two and <br />one-half inches or longer in length; without first requiring the donee or purchaser to identify <br />himself and to register in a book kept by the donor or seller for the purpose, giving name, <br />address and age. Any police officer shall be permitted to inspect any such book at any <br />time: <br />
