Calling a city-wide ban would be drastic and be burdensome for parking. <br /> Motion by Councilmember Litten to recommend adoption of Ord. 06-2022 with the word <br /> "whatever"removed in line two of section three. All members voted in favor. Motion passed. <br /> ORDINANCE 11-2022 -AN ORDINANCE to take effect immediately provided it <br /> receives the affirmative vote of at least five(5) members of Council, or otherwise to <br /> take effect and be in force after the earliest period allowed by law, amending <br /> Chapter 549.10, Fireworks, of the Codified Ordinances of the City of Lakewood in <br /> order to address and account for changes made to Ohio law and adopt a conforming <br /> local ordinance regulating fireworks. <br /> Assistant Prosecutor Fleck explained that HB 172 relaxed Ohio's fireworks laws to allow <br /> discharge and possession of fireworks but allows cities to restrict and ban their discharge. Prior <br /> to the enactment of the law, individuals purchasing fireworks within the state were required to <br /> sign an affidavit that they would bring the fireworks across state lines within 48 hours. <br /> The Committee and the Law Department discussed the city's practices for prosecuting fireworks <br /> crimes. The Law Department acknowledged that fireworks crimes are difficult to charge because <br /> police need to witness the crime. Prosecutor Miranda discussed a case a year and a half ago <br /> whereby a group of veterans with a history of PTSD presented video evidence of a large <br /> fireworks display going off. The Department investigated and used mediation. It also educated <br /> the veterans on the city's limitations. Approaching July 4h, the city also reminds people in water <br /> bills and on social media that it is illegal to discharge fireworks. <br /> Councilmember Baker raised awareness about problems that fireworks cause for pets and combat <br /> veterans. <br /> Through additional discussion, it was established that Ord. 11-2022 prohibits the discharge of <br /> fireworks within the City. It does not prohibit the possession, sale, or manufacture. <br /> The committee discussed the penalty in the ordinance which is Misdemeanor 1. The committee <br /> and the Law Department agreed that it was the appropriate penalty given the seriousness of the <br /> crime. <br /> A motion was made and seconded to recommend Ord. 11-2022 for adoption. All members voted <br /> in favor. Motion passed. Ord. 11-2022 recommended for adoption. <br /> ORDINANCE 14-2022 -AN ORDINANCE to take effect immediately provided it <br /> receives the affirmative vote of at least two thirds of the members of Council <br /> repealing Section 549.19 Pocket Knives, of the Lakewood Codified Ordinances. <br /> 3 <br />
