Baker, Bullock, Kepple, Marx, <br />RESOLUTIONNO. 2022-36 Rader, Shachner <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of at <br />least two thirds of the members of Council, or otherwise to take effect and be in force after the <br />earliest period allowed by law, authorizing the Mayor of the City of Lakewood to prepare and <br />submit an application to participate in the Ohio Public Works Commission State Capital <br />Improvement Program, Local Transportation Improvement Program or any other appropriate Ohio <br />Public Works Commission program that these projects qualify for and to execute contracts as <br />required for Program Year 2024. <br />WHEREAS, both the State Capital Improvement Program and the Local Transportation <br />Improvement Program provide financial assistance to political subdivisions for capital <br />improvements to public infrastructure; and <br />WHEREAS, the City of Lakewood is planning to make capital improvements to the water <br />mains at Glenbury Avenue, Marlowe Avenue (Athens to Detroit), and Mars Avenue (Athens to <br />Madison); and <br />WHEREAS, the infrastructure improvements described above are considered to be a priority <br />need for the community and are qualified projects under the OPWC programs; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self-government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Chatter of the city of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public peace, property, health and safety, and to provide for <br />the usual daily operation of municipal departments in that the OPWC application deadline is <br />September 2022 for the 2024 program year; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD: <br />Section 1. The Engineerr of the City of Lakewood is hereby authorized to prepare and <br />submit an application to participate in the Ohio Public Works Commission State Capital <br />Improvement Program, Local Transportation Improvement Program, or any other Ohio Public <br />Works Commission funding program that these projects qualify for. <br />Section 2. The Mayor, the Director of Public Works and the Director of Finance for the City <br />of Lakewood are authorized to enter into any agreements as may be necessary and appropriate for <br />obtaining this financial assistance. <br />
