FAX (440) 885-7139 <br />www.kolesurvey.com <br />Lake Erie Submerged Lands Legal Description <br />Adjacent to 17856Lake Road, City of Lakewood <br />Situated in the City of Lakewood and located within the waters of Lake Erie, County of Cuyahoga <br />and State of Ohio and known as being part of Original Rockport Township Section No. 23 conveyed to <br />Christopher Daniel D'Amico and Rebecca M. D'Amico by Deed recorded in AFN 202203040552 of <br />Cuyahoga County Deed Records and described as follows: <br />Beginning at a the southwest corner of land so conveyed to D'Amico and being in the north line <br />of Lake Road, 50.00 feet wide; thence North 17005'34" West along the west line of said land -so <br />conveyed to D'Amico, 274.87 feet to a point in an existing bluff and being the Principal Place of <br />Beginning of the Lease Property described; <br />1. Thence departing the D'Amico land along the littoral partition boundary between said D'Amico <br />and Saji T. Daniel, Trustee as determined by radial means, North 03048'22" West, 41.04 feet; <br />2. Thence departing the littoral partition boundary across the open waters of Lake Erie, North <br />90000'00" East, 122.82 feet to a point of curvature therein; <br />3. Thence southeasterly and continuing across the open waters of Lake Erie by a curve to the <br />right an arc distance of 23.51 feet, said arc having a radius of 35.21 feet, a delta of <br />38°15'06", and a chord which bears South 7015227" East, 23.07 feet to a point in the <br />existing north beach shoreline of Lake Erie; <br />4. Thence along said north beach shoreline of Lake Erie, southwesterly by a curve to the left an <br />arc distance of 85.95 feet, said arc having a radius of 253.75 feet, a delta of 1912428", and a <br />chord which bears South 67052'19" West, 85.54 feet to a point in said existing bluff of <br />D'Amico; <br />5. Thence along said existing bluff of D'Amico South 8815545" West, 62.67 feet to the Place of <br />Beginning and containing 0.0964 acres (4,201.01 square feet) of land as surveyed in <br />November of 2021 by Richard J. Kole, Ohio Surveyor #7889, of R.M. Kole & Associates, Corp., <br />Professional Land Surveyors. <br />Subject, however, to all legal rights -of -way of previous record. <br />Basis of bearings.
