ORDINANCE 26-2022 -AN ORDINANCE to take effect immediately provided it <br /> receives the vote of at least two thirds of the members of Council, or otherwise to <br /> take effect at the earliest period allowed by law, authorizing the City of Lakewood, <br /> Ohio to transfer title of an access drive (The Property), as more fully described in <br /> the quit claim deed attached as Exhibit "A", to West 117 Development Phantasy <br /> LLC. <br /> Director Leininger introduced the ordinance and explained that it authorizes the City to transfer <br /> the title of an alley to the West 117 Development. He noted that this anticipated transfer was <br /> incorporated into the City's development agreement with the developers as a way to support the <br /> project's expected economic development benefits. He explained that the alley separates the <br /> Fieldhouse on Hird(former Mack Products building) from the Phantasy, at the corner of Hird <br /> and Detroit. <br /> Councilmembers Kepple & Marx both expressed support for the transfer of the alleyway. Each <br /> mentioned that while on a tour of the development, they saw firsthand the importance of the <br /> alleyway for connecting two distinct portions of the project and completing its vision. <br /> Councilmember Rader questioned whether the alley had a public and if it will still provide public <br /> access. <br /> Director Leininger explained that the City is not transferring the entire alley because two <br /> businesses still need to access it. They will be able to exit from the alleyway onto a city-owned <br /> lot. He further discussed the developers' vision for a protected pedestrian alleyway connecting <br /> the development that will also include public art. <br /> In response to a question, Director Leininger provided assurances that police and fire have <br /> analyzed the layout for proper public safety access. In describing the city's research of the <br /> property, no easements or utilities were found on the property. <br /> Daniel Budish of West 117 Development thanked Council for its support of the project and <br /> further described his vision for the space. <br /> Councilmember Bullock summarized the benefits of the proposed transfer. <br /> Budish—alley will be a central focal point for restaurants and Detroit retail focal point. Oct 21st <br /> Field House to open. <br /> Motion was made and seconded to recommend adoption of Ordinance 26-2022. All members <br /> voted in favor. Motion passed. Ord. 26-2022 recommended for adoption. <br /> Approval of the minutes of the July 25, 2022 Housing, Planning & Development <br /> Committee meeting. <br /> 2 <br />
