(c) This section shall not apply if any beer or intoxicating liquor is being sold <br />or on public property in accordance with a special event permit issued <br />pursuant to Chapter 557, provided, however, such activity shall meet all <br />other applicable laws and regulations for the possession, sale and <br />consumption of beer or intoxicating liquor. <br />shall be and is hereby amended to read as follows: <br />905.13 DISORDERLY CONDUCT; INTOXICATION; SMOKING <br />(a) Sleeping or protracted lounging on the seats or benches, loud, boisterous, <br />threatening, abusive, insulting or indecent language, disorderly conduct or <br />behavior, or and any act tending to a breach of the public peace, are <br />prohibited in the parks. <br />(b) No person shall take intoxicating liquor into any park. No intoxicated <br />person shall enter or remain within any of the parks. This section shall <br />not apply if any beer or intoxicating liquor is being sold or on public <br />property in accordance with a special event permit issued pursuant to <br />Chapter 557, provided, however, such activity shall meet all other <br />applicable laws and regulations for the possession, sale and <br />consumption of beer or intoxicating liquor. <br />(c) No person shall possess lighted Smoking Material in any form or utilize <br />an Electronic Smoking Device in any of the parks. As used herein, <br />"Smoking Material" and "Electronic Smoking Device" shall have the <br />same meaning as in Section 523.01. Section 523.01, Indoor Air Pollution, of the Codified Ordinances of the City of <br />Lakewood, currently reading as follows: <br />523.01 DEFINITIONS. <br />As used in this chapter: <br />(a) 'Bar" means any establishment licensed by the Ohio Department of Liquor <br />Control to sell intoxicating beverages for consumption on the premises and <br />in which the service of food is only incidental to the consumption of such <br />beverages. An establishment which would usually be defined as an "eating <br />establishment" under subsection (b) hereof may, during certain periods (not <br />including regular meal times) when the service of food is only incidental <br />to the consumption of intoxicating beverages, be defined temporarily as a <br />"'bar." <br />(b) "Eating establishment" means any restaurant, coffee shop, cafeteria, <br />luncheonette, tavern, cocktail lounge, sandwich stand, soda fountain or any <br />other establishment (excluding bars) where cooked or otherwise prepared <br />
