Placed on 1st reading & <br />referred to HPD 9/6/22; 2nd <br />reading 9/19/22 <br />ORDINANCE N0.26-2022 BY. <br />Baker, Bullock, Kepple, Litten, <br />Marx, Rader, Shachner <br />AN ORDINANCE to take effect immediately prove e it receives e vo e o a eas o <br />thirds of the members of Council, or otherwise to take effect at the earliest period allowed by law, <br />authorizing the City of Lakewood, Ohio to transfer title of an access drive (The Property), as more <br />fully described in the quit claim deed attached as Exhibit "A", to West 117 Development Phantasy <br />LLC. <br />WHEREAS, the City of Lakewood, Ohio (the "City") is desirous of encouraging economic <br />development within the city to create jobs for its residents and to increase the City's tax base; and <br />WHEREAS, in furtherance of those efforts, the City has been working with West 117 <br />Development on the renovation and repurposing of properties near the east end of Lakewood on <br />Detroit Avenue; and <br />WHEREAS, the city owns and maintains an access drive abutting West 117 Development's <br />project site on Detroit Avenue, and <br />WHEREAS, it is in the best interest of the City to transfer an access drive directly abutting <br />the development site to West 117 Development for use as part of the project allowing the <br />development to have free access to the drive and transfer the maintenance of the drive to West 117 <br />Development; and <br />WHEREAS, as authorized by Ordinance 22-2021, the City and West 117 Development <br />et.al. entered into a Development Agreement on July 21, 2021, which among other items provided <br />for the transfer of The Property; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments, in that this agreement should be executed as soon <br />as possible to continue to support this project; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD: <br />Section 1. The Mayor or any other officer of the City is hereby authorized to transfer <br />title to the Property to West 117 Development Phantasy LLC via quit claim deed for $1.00 (One <br />Dollars), and to take any and all other actions required to effectuate the transfer of the property, <br />including, but not limited to, recording the deeds with the Cuyahoga County Treasurer. <br />Section 2.
