An employee required to perform their duties in stations other than their regularly assigned station will be <br />provided with lockers for the protection of their personal property. <br />ARTICLE 25 SEVERABILITY <br />25.01 If any provision of the Agreement, or the application of such provision, should be rendered or de- <br />clared invalid by any final court action or by reason of any existing, amended or subsequently enacted <br />legislation, the remaining parts or portion of the Agreement shall remain in full force and effect, and shall <br />be otherwise affected by any of the above -named actions. <br />ARTICLE 26 PREVAILING RIGHTS <br />26.01 All rights and working conditions enjoyed by the employees at the present time, such as firehouse <br />supplies (soap, toilet paper, light bulbs, etc.), firehouse tools (lawn mowers, tools for minor repairs), fire- <br />house linens, firehouse utilities (heat, light, water) and other similar benefits of the job, which are not in- <br />cluded in this Agreement, shall remain in full force. <br />26.02 For the term of this Agreement, the City shall not diminish the benefits enumerated above. <br />26.03 An employee of the Division of Fire shall have the opportunity to examine their own individual <br />personnel file once every six (6) months. In order for an employee to have access to their personnel file, <br />the employee must give the Human Resources Director one (1) day notice of their request, and the actual <br />examination must be in the presence of the Human Resources Director, or designee, Monday through Fri- <br />day, during normal working hours. <br />26.04 Meal Hours <br />A. Employees of the Division who are on duty New Year's Day, Easter Sunday, Thanksgiving Day and <br />Christmas Day shall be guaranteed two (2) hours off for meal hours. This meal bonus shall be eliminated <br />effective January 1,2011 per the conditions outlined in Section IS.OS-B. <br />26.05 Trading Time <br />A. An employee may trade time if the change does not interfere with the operation of the Division of Fire. <br />Trading of four (4) hours or less must have the approval of the employee's immediate supervisor. All other <br />trades must have the approval of the Assistant Chief. All trades are limited to employees within the bar- <br />gaining unit. <br />ARTICLE 27 AGREEMENT SUPERSEDES <br />27.01 Any City ordinance, Division of Fire rules, regulations, general and special orders, Civil Service <br />regulations and verbal orders that directly conflict with express terms of this Agreement shall be superseded <br />by this Agreement. <br />ARTICLE 28 OBLIGATION TO NEGOTIATE <br />28.01 The City and the Association acknowledge that during negotiations, which preceded this Agreement, <br />each had the unlimited right and opportunity to make demands and proposals with respect to any subject or <br />matter not removed by law from the area of collective bargaining/negotiations and that the understandings <br />and agreements arrived at by the parties after the exercise of that right and opportunity are set forth in this <br />Agreement. <br />16 <br />
