The committee also discussed its vacancies on boards and commissions and a strategy for <br /> recruiting applicants. <br /> Motion by President Litten, seconded by Vice President Kepple to receive and file oral report. <br /> All in favor. Motion passed. <br /> 2. Report from Housing, Planning & Development Committee regarding meetings held <br /> November 14, 2022 & November 21, 2022. <br /> Councilmember Bullock provided the following oral report: <br /> The Housing, Planning, & Development Committee met on November 14 to consider the <br /> next two items on the agenda: Substitute Ordinance 33-2022 and Ordinance 34-2022. Those are <br /> two proposed changes to our zoning code of outdoor dining and different categories of tattooing. <br /> Both went to the Planning Commission first and came back to us for an insigh ful discussion with <br /> the planning staff. Briefly what the ordinances would do is extend the COVID era rules for <br /> outdoor dining beyond the end of the public emergency. There is a common feeling among the <br /> business community and the administration that during the crisis that it has been a positive <br /> experience that initiated additional investment into outdoor patios. There is every reason to <br /> believe it can continue to be successful. <br /> There was one amendment proposed by the Planning Commission that for certain large <br /> outdoor dining areas where there could be a parking impact, the impact is reflected and <br /> accounted for. The proposed change is that the Planning Commission on a case-by-case basis <br /> would have discretion to properly adjust the parking. If an establishment has 50-70 spots in <br /> additional outdoor seating, it could have a parking impact and could potentially be an <br /> adjustment the planning commission could make when the business comes to the Planning <br /> Commission for a renewal or new application for a permit. The committee welcomed the <br /> proposal from the Administration and agreed to it. <br /> The next was Ordinance 34-2022, which was the creation ofdifferent categories for the <br /> tattooing businesses. The existing authorized tattooing businesses have different geographic <br /> distances minimums which limit the number ofpermits available in the city. Those limits with the <br /> body art tattoos would not preclude medical tattooing or cosmetic tattooing which are new <br /> growing practices. That was received as a reasonable proposal, and we agreed to it. <br /> For the November 21s'meeting, we had a consideration of Ordinance 12-2021A which resulted <br /> in the Committee recommending to the full Council for adoption that proposed ordinance, with <br /> the anticipated discussion most likely occurring next council meeting, ofSection ID which <br /> affects the cap on the late fee for leases that would go through the process outlines. <br /> Fundamentally this would allow tenants to make catch-up payments, late fees, and court costs. <br /> The proposal was to make this permanent. <br /> Motion by Councilmember Bullock, seconded by President Litten to receive and file the oral <br /> communication. All in favor. Motion passed. <br /> 2 <br />
