AGREEMENT <br />This Agreement is entered into between the City of Lakewood, Ohio, hereinafter referred to as <br />the "City," and Western Cuyahoga Lodge No. 25, Fraternal Order of Police, Patrol Officers, <br />Lakewood Division, herein after referred to as the "FOP Patrol Officers." <br />The purpose of this Agreement is to provide a fair and responsible method of enabling <br />employees covered by this Agreement to participate, through representation, in the establishment <br />of terms and conditions of their employment, and to establish a peaceful procedure for the <br />resolution of all differences between the parties. <br />ARTICLE 1 <br />The Administration recognizes the FOP as the sole and exclusive bargaining representative for a <br />unit comprised of all full-time, sworn law enforcement personnel below the rank of Sergeant in <br />the City of Lakewood, for the purpose of collective bargaining with respect to rates of pay, <br />wages, hours of work, and all other conditions of employment. <br />ARTICLE 2 NON-DISCRIMINATION <br />Both the City and the FOP recognize their respective responsibilities under the Federal and State <br />Civil Rights Law, Fair Employment Practice Acts, and other similar constitutional and statutory <br />requirements. Therefore, both the City and the FOP hereby affirm their commitments, legal and <br />moral, not to discriminate, in any manner, relating to employment on the basis of race, color, <br />creed, national origin, sex, age, disability, gender identity/expression, genetic information, <br />military status, veteran status, sexual orientation, union membership or activity, or ancestry. The <br />FOP shall share equally, with the City, the responsibility for applying this provision of the <br />Agreement. <br />ARTICLE 3 CHECK -OFF <br />3.01 The City will deduct, on a monthly basis, dues from the pay of employees covered by this <br />Agreement, upon receipt from the FOP of individually, written authorization cards voluntarily <br />executed by an employee for that purpose, and bearing the employee's signature, provided that <br />any employee shall have the right to revoke such authorization, pursuant to the provisions of <br />Section 4117 of the Ohio Revised Code. <br />3.02 Deductions under this article shall be made during the first pay period of each month, but <br />if the employee's pay for that period is insufficient to cover FOP dues, the City will make a <br />deduction from the pay earned during the next period or a subsequent period. <br />3.03 All deductions under this article, accompanied by a list of all employees for whom <br />deductions have been made, shall be transmitted to the FOP no later than the fifteenth (151h) day <br />following the end of the pay period in which the deduction is made, and, upon receipt, the FOP <br />shall assume full responsibility for the disposition of all funds deducted. <br />
