Baker] Bullock, Kepple, Litten, <br />RESOLUTION NO.2022-66 BY: Marx, Rader, Shachner <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force after the <br />earliest period allowed by law, authorizing the Mayor of the City of Lakewood, Ohio, to enter <br />into an Agreement with the American Federation of State, County and Municipal Employees, <br />Local 108, Public Works Employees, (AFSCME) for a three-year period commencing January <br />1, 2023 and ending December 31, 2025, and ratifying that Agreement. <br />WHEREAS, the administration has conducted extensive negotiations with the AFSCME <br />(the "Union") as the bargaining representative for certain employees of the City; and <br />WHEREAS, such negotiations have provided a tentative agreement between the parties <br />for the years 2023-2025; and <br />WHEREAS, Council and the administration have reviewed the tentative agreement and <br />desire to ratify and adopt the agreement; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments, in that the current agreement with the <br />Union is set to expire on December 31, 2022; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Council hereby authorizes the Mayor to enter into the Agreement for a three- <br />year period with the Union, on behalf of certain employees of the City, commencing January 1, <br />2023 and ending December 31, 2025, and hereby ratifies the Agreement; the form of the <br />Agreement is attached as Exhibit A and shall be on file in the office of the Director of Law. <br />Section 2. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution occurred in an open meeting of this Council and that <br />all deliberations of this Council and any of its committees that resulted in such actions were in <br />meetings open to the public and in compliance with legal requirements. <br />Section 3. This resolution is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare and for the <br />usual daily operation of the City for the reasons set forth and defined in the preamble to this <br />resolution, and provided it receives the affirmative vote of at least two thirds of the members of <br />
