Baker] Bullock, Kepple, Litten, RESOLUTION NO.2022-66 BY: Marx, Rader, Shachner A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, authorizing the Mayor of the City of Lakewood, Ohio, to enter into an Agreement with the American Federation of State, County and Municipal Employees, Local 108, Public Works Employees, (AFSCME) for a three-year period commencing January 1, 2023 and ending December 31, 2025, and ratifying that Agreement. WHEREAS, the administration has conducted extensive negotiations with the AFSCME (the "Union") as the bargaining representative for certain employees of the City; and WHEREAS, such negotiations have provided a tentative agreement between the parties for the years 2023-2025; and WHEREAS, Council and the administration have reviewed the tentative agreement and desire to ratify and adopt the agreement; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments, in that the current agreement with the Union is set to expire on December 31, 2022; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. Council hereby authorizes the Mayor to enter into the Agreement for a three- year period with the Union, on behalf of certain employees of the City, commencing January 1, 2023 and ending December 31, 2025, and hereby ratifies the Agreement; the form of the Agreement is attached as Exhibit A and shall be on file in the office of the Director of Law. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution occurred in an open meeting of this Council and that all deliberations of this Council and any of its committees that resulted in such actions were in meetings open to the public and in compliance with legal requirements. Section 3. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this resolution, and provided it receives the affirmative vote of at least two thirds of the members of
