ARTICLE 12 SENIORITY <br />12.01 Seniority, for the purpose of layoff, shall be an employee's uninterrupted length of <br />continuous service with the City within a classification included in the bargaining unit. An <br />employee shall have no seniority during the probationary period provided in Article 11, but upon <br />completion of the probationary period, seniority shall be retroactive to the date of hire. <br />Management personnel shall not accumulate any seniority while employed outside the bargaining <br />unit. <br />12.02 Upon the request of a Chapter Officer, but not more than twice a year, the City shall provide <br />the Union with a copy of the seniority lists and these lists shall be updated and provided as <br />requested. The seniority lists shall contain, in order of seniority, the name, division, classification <br />and date of hire for each employee. Additional lists shall be provided as requested by the <br />union. Seniority shall be broken when an employee: <br />Quits or resigns. <br />2. Is discharged for just and proper cause. <br />Is laid off for a period of more than twenty-four (24) consecutive months. <br />4. Fails to report to work when recalled from layoff within five (5) calendar days from <br />the date on which the certified mail is received by the employee. The City will send the <br />employee notice by certified mail (to the employee's last known address as shown on <br />the City's records). <br />5. Is absent without leave for three (3) or more working days, unless a reasonable excuse <br />for absence is shown. <br />12.03 Bargaining unit employees appointed to the position of supervisor, shall lose all bargaining <br />unit seniority rights on the ninetieth (90'h) day following their appointment. <br />12.04 Years of service for purposes of promotion shall be defined as years of service within a <br />classification included in the bargaining unit. <br />ARTICLE 13 HOURS OF WORK <br />13.01 The normal workweek for regular full-time employees shall be forty (40) hours of work in <br />five (5) days of eight (8) consecutive hours each day, exclusive of the time allotted for meals, <br />during the period starting at 12:01 a.m. Sunday to midnight Saturday. An employee's workday <br />begins with the commencement of his regular shift. This section shall not be construed as a <br />guarantee of hours of work per day or per week, and the City reserves the right to establish and <br />change hours of work, shifts and schedule of hours, provided that this section shall not be construed <br />to give the City the right to reduce the workweek below forty (40) hours per week for any full- <br />time, permanent, hourly employee. <br />10 <br />
