B. The parties expressly agree that the concept of jury duty pay is for the employee to <br />be able to serve jury duty without the loss of compensation for such time, and not <br />to provide a windfall for employees called to jury duty. Accordingly, jury duty pay <br />will be calculated to ensure that the employee does not lose any straight -time <br />compensation he/she would have earned absent jury service. <br />17.03 Military Leave <br />An employee shall be granted a leave of absence for military duty in accordance with state and <br />federal law. <br />ARTICLE 18 SICK TIME PAY & PAID PARENTAUCHILDBIRTH <br />LEAVE <br />18.01 All employees shall earn sick time pay at the rate of 4.6 hours for every eighty (80) hours <br />paid and may accumulate such sick time to nine hundred and sixty (960) hours. Sick time pay <br />may be utilized on account of illness or injury incapacitating the employee from working and <br />requiring the employee's absence or to care for sick or injured, pregnant, or newborn members of <br />the employee's immediate family. Immediate family for the purpose of this Article shall be defined <br />as spouse, son, daughter, stepchild, mother, father or stepparent. If the marriage of people of same <br />sex is no longer permitted by law the definition of spouse will include same -sex partners and the <br />definition of stepchild will include the children of same -sex partners. <br />18.02 If the employee is absent from work for more than two (2) consecutive days, the employee <br />must complete a Certificate of Illness or Injury form and have their physician complete the <br />attending physician's statement or attach an acceptable statement from the physician to the <br />certificate that indicates that the employee is able to return to regularly assigned duties. Sick <br />absences will be counted even if interrupted by other days off, i.e. sick Friday, regular scheduled <br />days off Saturday, Sunday, sick Monday and Tuesday will count as more than two (2) consecutive <br />working days. <br />18.03 Any abuse or patterned use of sick time shall be just and sufficient cause for disciplinary <br />action, and the City's Sick Abuse Policy shall apply. <br />18.04 In the event an employee becomes or continues to be incapacitated from work by illness or <br />injury, after exhaustion of his acquired sick time, they may apply for donations of time according <br />to the Sick Time Donation policy. <br />18.05Sick Time and Conversion <br />A. Employees may accumulate one hundred and twenty (120) days of unused sick time <br />and they shall be allowed to convert twenty five (25) percent of said sick time into a <br />lump sum cash payment, up to a maximum of thirty (30) days ofpay, upon retirement, <br />resignation or death. This lump sum sick time conversion payment will be made <br />within thirty (30) days after retirement, resignation or death. Any employee, at the <br />15 <br />
