Placed on 1st reading & referred to <br />FIN 12/19/22; 2nd reading 1/3/23 <br />Please substitute for original <br />Baker, Bullock, Kepple, Marx, <br />ORDINANCE NO.49-2022 BY: Rader, S ha cline r <br />AN ORDINANCE to take effect immediately upon affirmative vote of at least two thirds <br />of the members of Council, or otherwise to take effect and be in force at the earliest period allowed <br />by law, further delineating the acceptable uses and purposes of the Parking Meter Fund, Section <br />129.16 of the Codified Ordinances, to include new revenue and expenses associated with <br />electronic vehicle charging (EV) stations, parking meters, electric scooters, and public space <br />acquired or used to facilitate alternative forms of transportation . <br />WHEREAS, the City of Lakewood has installed multiple EV stations throughout the City <br />and established rates for the usage of the charging stations; and <br />WHEREAS, the installation, maintenance, and operation of EV stations are proprietary <br />functions and not generally governmental functions; and <br />WHEREAS, EV stations are producing revenue which should be used to offset the cost of <br />power and maintenance associated with the chargers and to help fund future installation and <br />maintenance of EV stations; and <br />WHEREAS, EV stations available to the public have and will continue to be installed in <br />public parking spaces located throughout the City; and <br />WHEREAS, other alternative forms of transportation that occupy public space, including <br />the current pilot scooter program, may be introduced as a necessary evolution to the Parking Meter <br />Fund as currently operated; and <br />WHEREAS, in order to facilitate those goals, it is necessary and desirable to expand the <br />current Parking Meter Fund to better track revenue and expenditures related to EV stations, parking <br />meters, electric scooters, and the use of public space to facilitate alternative forms of <br />transportation; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure necessary for the immediate preservation of the public <br />property, health, and safety and to provide for the usual daily operation of municipal departments <br />in that the ordinance will allow the City to better track and project revenue and expenses related <br />to EV charging stations, parking meters, electric scooters, and related uses of public space. Now <br />therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO <br />Section 1. That Section 129.16 Parking Meter Fund of the Lakewood Codified <br />Ordinances, currently reading as follows: <br />
