1st read 1/17/23; 2nd reading 2/6/23 <br />Please substitute for the original <br />Baker, Bullock, Kepple, Marx, Rader <br />ORDINANCE NO. 01-2023 BY: <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote <br />of at least two thirds of the members of Council, or otherwise to take effect and be in force at <br />the earliest period allowed by law, to approve the editing and inclusion of certain ordinances as <br />parts of the various component codes of the Codified Ordinances and to provide for the <br />publication of such new matter. <br />WHEREAS, various ordinances of a general and permanent nature have been adopted by <br />Council but not yet included in the Codified Ordinances of the City; and <br />WHEREAS, given the above, now is an appropriate time to contract with the City's <br />codifier, American Legal Publishing, to produce a revised and updated version of the Codified <br />Ordinances of the City; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments, in that the publication and distribution of <br />this latest update to the Lakewood Codified Ordinances is an essential resource and reference <br />for government operations; now, therefore <br />BE IT ORDAINED BY CITY OF LAKEWOOD, OHIO: <br />Section 1. The editing, arrangement and numbering and renumbering of the following <br />ordinances and resolutions and parts of ordinances and resolutions are hereby approved as parts <br />of the various component codes of the Codified Ordinances of the City, so as to conform to the <br />classification and numbering system of the Codified Ordinances: <br />33-2022 <br />11/21/22 <br />1161.03(t), 1129.13 <br />Expand outdoor/seasonal dining <br />34-2022 <br />11/21/22 <br />Enact 1161.03 (AA) <br />Distinguish medical and cosmetic tattooing <br />49-2022 <br />2/6/23 <br />129.16 <br />Use of revenues from Parking Fund <br />02-2023 <br />2/6/23 <br />New Section <br />Enact permanent Pay to Stay policy <br />Section 2. The Third Amended Charter published within the Codified Ordinances is the <br />official charter of the City of Lakewood. <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in such <br />
