The committee and the Finance Director discussed the role of Board of Control. Director <br /> Rancatore stated that the Board of Control process does not interfere in this case. However, he <br /> noted that the Board of Control threshold is a fixed figure that has not been adjusted in many <br /> years. He suggested that the Board of Control threshold be revisited in the future to streamline <br /> purchasing. <br /> Motion by Chair Shachner to substitute Ord. 03-2023 with the version provided in committee. <br /> All members voted in favor. Motion passed. Ord. 03-2023 substituted. <br /> Motion by Chair Shachner to adopt Ord. 03-2023 as substituted. All members voted in favor. <br /> Motion passed. Substitute Ord. 03-2023 recommend for adoption. <br /> RESOLUTION 2023-08 -A RESOLUTION to take effect immediately provided it <br /> receives the affirmative vote of at least two thirds of the members of Council, or <br /> otherwise to take effect and be in force after the earliest period allowed by law, <br /> permitting the Mayor, Director of Public Works, Finance Director and Purchasing <br /> Manager to purchase certain vehicles and equipment without advertising and <br /> competitive bidding or specific approval of Council as required by Lakewood <br /> Codified Ordinance §111.04. (1st read& referred to Finance 2/6/23) <br /> Finance Director Rancatore spoke to the recent challenges the city has faced in procuring <br /> necessary equipment. He explained that vendors now offer only a small window of opportunity <br /> for bidding and these windows can close within a few days or less. <br /> Chairman Shachner acknowledged that Lakewood Codified Ordinances Section 111.04 provides <br /> a number of exceptions to ordinary process of competitive bidding. He asked the administration <br /> to clarify which exceptions it is seeking. <br /> Law Director Vargo replied that the administration is seeking an exception under Sections <br /> 111.04 (a)(3) and 111.04 (a)(10). He noted that at this time the administration does not have the <br /> form agreement referenced in 111.04 (a)(10)but that it will be provided to Council once the <br /> administration is ready to act on purchasing the desired equipment. In addition to limiting the <br /> dollar amount of the purchases, this provision provides an additional reassurance, or"check" in <br /> the process. <br /> The committee and the administration expressed agreement that there are ample financial <br /> controls built into this agreement to allow the administration to forgo competitive bidding. <br /> Public Works Director Gordon explained that problematic supply chain issues compel the city to <br /> act fast when equipment becomes available. He explained how without taking action to procure <br /> the necessary equipment in 2023, the city can quickly begin falling years behind in its purchases. <br /> Fleet Manager Holman shared details of specific situations in which quick action is necessary. <br /> He stated that public bidding will be used when practical, but that it is not practical in all <br /> 2 <br />
