City of Lakewood <br />FY23 HUD Annual Action Plan <br />Proposed Contingency Provision Language <br />Introduction <br />■ FY23 CAC allocation recommendations are based on estimates of Lakewood's 2023 CDBG ($1,850,358) and ESG ($160,000) <br />awards. <br />■ Because the City's FY23 Annual Action Plan cannot be submitted until HUD announces Lakewood's actual FY23 CDBG & ESG <br />awards, which typically occurs several months into the 2023 program year, the draft Action Plan issued for public review and <br />comment must include these estimates. <br />■ HUD requires the inclusion of contingency provision language in the City's draft Action Plan explaining how estimated allocations <br />will be adjusted to match actual FY23 CDBG & ESG awards once they are known. <br />■ The Department of Planning & Development proposes the following CDBG & ESG contingency provision language for inclusion <br />in Lakewood's draft FY23 Action Plan. <br />Community Development Block Grant <br />In the event Lakewood's FY23 CDBG award is less than the City's $1,850,358 estimate, allocation decreases shall be distributed as <br />follows: <br />■ To comply with the CDBG program's statutory 15% Public Services funding cap, total FY23 Public Services allocations will be <br />reduced from $277,553 (15% of $1,850,358) to 15% of the City's actual FY23 CDBG award. <br />■ Line -item allocation decreases will be distributed proportionally among Public Services activities receiving an FY23 allocation <br />according to each activity's original percentage of total FY23 Public Services allocations. <br />■ If necessary, additional funding reductions required to align FY23 CDBG allocations with Lakewood's actual FY23 CDBG award <br />will be distributed among non -Public Services activities receiving an FY23 allocation at the discretion of Department of Planning <br />& Development staff in accordance with Lakewood's community and economic development goals and objectives; approved City <br />planning documents; and CDBG regulatory requirements. <br />In the event Lakewood's FY23 CDBG award is greater than the City's $$1,850,358 estimate, allocation increases shall be distributed <br />as follows: <br />■ Total FY23 Public Services allocations will be increased from $285,000 (15% of $1,850,358) to 15% of the City's actual FY23 <br />CDBG award. <br />■ Line -item allocation increases will be distributed proportionally among Public Services activities with estimated allocations less <br />than 100% of their FY23 funding request according to each activity's original percentage of total FY23 Public Services allocations. <br />■ The balance of the difference between Lakewood's estimated and actual FY23 CDBG awards will be distributed among non - <br />Public Services activities receiving an FY23 allocation at the discretion of Department of Planning & Development staff in <br />accordance with Lakewood's community and economic development goals and objectives; approved City planning documents; <br />and CDBG regulatory requirements. <br />Emergency Solutions Grant <br />In the event Lakewood receives an FY23 ESG award less than the City's $160,000 estimate, allocation decreases shall be distributed <br />as follows: <br />■ Funding reductions in an amount equal to the difference between $160,000 and the City's actual FY23 ESG award will be <br />distributed among Lakewood Community Services Center's Homelessness Prevention and Emergency Shelter programs <br />with exact amounts determined jointly by Department of Planning & Development staff and LCSC's Executive Director. <br />■ The Lakewood Department of Planning & Development's ESG Administration allocation will remain $5,000. <br />In the event Lakewood receives an FY23 ESG award greater than the City's $160,000 estimate, allocation increases shall be <br />distributed as follows: <br />■ Funding increases in an amount equal to the difference between $160,000 and the City's actual FY23 ESG award will be <br />distributed between LCSC's Homelessness Prevention and Emergency Shelter programs with exact amounts determined <br />jointly by Department of Planning & Development staff and LCSC's Executive Director. <br />
