Discussion: In response to a question by President Litten, Councilmember Bullock explained that the latest version of the ordinance on tonightÓs docket reflects several rounds of discussion and changes in committee. The committee recommends adoption of the version appearing on tonightÓs docket. On the motion: All members voted in favor. Motion passed. *** 3. S. ORDINANCE 10-2023 - AN ORDINANCE to take effect January 1, 2024 to establish new Chapter 781, Automobile Business Operations, of the Lakewood Codified Ordinances st to establish regulations for automobile related businesses within the City of Lakewood. (1 nd read & referred to HPD 5/1/23, 2 reading 6/5/23) (pg. 2) Motion by President Litten, seconded by Vice President Kepple to adopt S. Ord. 10-2023. Discussion: In response to a question by Councilmember Shachner, Law Director Vargo explained that there have been three different versions of Ordinance 10-2023. Significant changes were made between the original and the second version. Only minor changes were made between the second version and the final version. Director Vargo described the public input that was solicited and received between the first and second versions and how that input was incorporated. He described the main concerns brought forth by members of the industry and how those were addressed. In response to questions from Councilmember Shachner, Director Vargo explained how the city intends to conduct inspections and how other industries are regulated within the city. Director Vargo further articulated that regulation of parking begins as soon as the customer hands over their keys to the repair shop, and not before that time. He explained that no other businesses are allowed to store or sell inventory from the public right of way without additional regulations, such as in the case of parklets. In response to questions, Directors Vargo and Leininger explained the cityÓs existing process for providing leased spaces through a conditional use permit. Public Comment: Keith Davey Î 2131 Riverside Drive Mr. Davey objected to the concept of municipalities requiring permits for business operations.
