DocuSign Envelope ID: 8DCB8AEC-F51 F-457F-AEB4-5612600EA2B0 <br />RESOLUTION NO.2023-42 BY: Baker, Litten, Marx, <br />Rader, Shachner <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of at <br />least two thirds of the members of council, or otherwise to take effect at the earliest period allowed <br />by law, authorizing the Director of Public Works and City Engineer, to prepare and submit an <br />application to participate in the Ohio Public Works Commission State Capital Improvement Program, <br />Local Transportation Improvement Program or any other appropriate Ohio Public Works <br />Commission ("OPWC") program that the 2025 Watermain Replacement Project qualifies for and to <br />execute contracts as required. <br />WHEREAS, both the State Capital Improvement Program and the Local Transportation <br />Improvement Program provide financial assistance to political subdivisions for capital improvements <br />to public infrastructure; and <br />WHEREAS, the City of Lakewood is planning a watermain improvement in connection with <br />the project for 2025 which includes portions of Northland Avenue (Delaware to Hilliard and Madison <br />to Detroit) and Norton Avenue (Webb to Granger); and <br />WHEREAS, the infrastructure improvements described above are considered to be a priority <br />need for the community and are qualified projects under the OPWC programs; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self-government and to adopt and enforce within their <br />limits such local police, sanitary and other regulations as are not in. conflict with general laws; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution <br />is an emergency measure and that it shall take effect immediately, because the OPWC application <br />deadline is November 5, 2020; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Director of Public Works and City Engineer of the City of Lakewood are <br />hereby authorized to prepare and submit an application to participate in the Ohio Public Works <br />Commission State Capital Improvement Program, Local Transportation Improvement Program, or <br />any other Ohio Pubic Works Commission funding program for which the projects identified in the <br />preamble qualify. <br />Section 2. The Mayor, the Director of Public Works, Director of Law and the Director of <br />Finance for the City of Lakewood are authorized to enter into any agreements as may be necessary <br />and appropriate for obtaining this financial assistance. <br />Section 3. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this resolution were adopted in an open meeting of this Council, and that all <br />
