DocuSign Envelope ID: 8DCB8AEC-F51 F-457F-AEB4-5612600EA2B0 RESOLUTION NO.2023-42 BY: Baker, Litten, Marx, Rader, Shachner A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of council, or otherwise to take effect at the earliest period allowed by law, authorizing the Director of Public Works and City Engineer, to prepare and submit an application to participate in the Ohio Public Works Commission State Capital Improvement Program, Local Transportation Improvement Program or any other appropriate Ohio Public Works Commission ("OPWC") program that the 2025 Watermain Replacement Project qualifies for and to execute contracts as required. WHEREAS, both the State Capital Improvement Program and the Local Transportation Improvement Program provide financial assistance to political subdivisions for capital improvements to public infrastructure; and WHEREAS, the City of Lakewood is planning a watermain improvement in connection with the project for 2025 which includes portions of Northland Avenue (Delaware to Hilliard and Madison to Detroit) and Norton Avenue (Webb to Granger); and WHEREAS, the infrastructure improvements described above are considered to be a priority need for the community and are qualified projects under the OPWC programs; and WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits municipalities to exercise all powers of local self-government and to adopt and enforce within their limits such local police, sanitary and other regulations as are not in. conflict with general laws; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, because the OPWC application deadline is November 5, 2020; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The Director of Public Works and City Engineer of the City of Lakewood are hereby authorized to prepare and submit an application to participate in the Ohio Public Works Commission State Capital Improvement Program, Local Transportation Improvement Program, or any other Ohio Pubic Works Commission funding program for which the projects identified in the preamble qualify. Section 2. The Mayor, the Director of Public Works, Director of Law and the Director of Finance for the City of Lakewood are authorized to enter into any agreements as may be necessary and appropriate for obtaining this financial assistance. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all
