DocuSign Envelope ID: 3D854E66-75C7-4714-90B6-505F26F1 D1 DD <br />RESOLUTION NO. 2023-50 BY: Baker , Bullock, Kepp l e , <br />Litten, Shachner <br />A RESOLUTION to take effect immediately provided it receives the vote of at least two <br />thirds of the members of Council, or otherwise to take effect at the earliest period allowed by <br />law, authorizing the Mayor to execute for an on behalf of the City of Lakewood, a public entity <br />established under the laws of the State of Ohio, an application and to file it in the appropriate <br />State office for the purpose of obtaining certain Federal financial assistance under the Disaster <br />Relief Act (Public Law 288, 23rd Congress) or otherwise available from the President's Disaster <br />Relief Fund. <br />WHEREAS, the City has secured $287,794.11 in funding through the Building Resilient <br />Infrastructure and Communities grant program, the City has a required match of $95,931.37; <br />and <br />WHEREAS, this grant will provide partial funding for the Cliff outfall project; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this reso- <br />lution is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments, in that the this application is due within 30 days <br />of notification; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. The Mayor is hereby authorized to execute for an in behalf of the City of <br />Lakewood, a public entity established under the laws of the State of Ohio, an application and any <br />other necessary agreements, and to file it in the appropriate State office for the purpose of obtain- <br />ing certain Federal financial assistance under the Disaster Relief Act (Public Law 288, 23rd <br />Congress) or otherwise available from the President's Disaster Relief Fund. <br />Section 2. That the City Engineer is hereby designated Project Manager for purposes of <br />this grant and is authorized to execute any required documents related to the grant. <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and any of its committees that resulted in such <br />formal action, were in meetings open to the public, in compliance with all legal requirements. <br />Section 4. This resolution is hereby declared to be an emergency measure necessary for <br />
