<br />MINUTES OF COMMITTEE OF THE WHOLE <br />OCTOBER 30, 2023 <br />AUDITORIUM <br />Present: Councilmembers Baker, Bullock, Kepple, Litten, Marx, Shachner <br />lso Present: Mayor George, Law Director Vargo, Finance Director Rancatore, Human <br />A <br />Resources Director Dillinger, Animal Control Officer (ACO) Supervisor Crawford, Council <br />Office staff <br />Call to Order: 6:39 p.m. <br />Approval of the minutes of the July 17, 2023 and September 18, 2023 <br />Committee of the Whole Meetings <br />Motion was made by Committee Chair Litten and seconded by Vice President Kepple to approve <br />thth <br />the minutes of the July 17 and September 18meetings of Committee of the Whole. All in <br />favor, motion passed. Minutes approved. <br />President Litten moved Resolution 2023-52 to the top of the agenda due to the likelihood of <br />entering executive session. <br />RESOLUTION 2023-52 - A RESOLUTIONto take effectimmediatelyprovidedit <br />receives the affirmative vote of at least two thirds of the members of Council, or <br />otherwise to take effect and be in force after the earliest period allowed by law, <br />authorizing the Mayor or Director of Law to enter into an agreement with an <br />engineering contractor of the City, to accept the amount of $400,000 for the full and <br />final settlement of all claims under the contractor’s agreement. (referred to COW <br />10/16/23) <br />Motion made and seconded to enterexecutive session for the purpose of conferences with an <br />attorney for the public body concerning disputes involving the public body that are the subject of <br />pending or imminent court action. A roll call was conducted as follows: <br />Yes: Baker, Bullock, Kepple, Litten, Marx, Shachner <br />Nays: None <br />Motion passed. Committee of the Whole entered executive session at 6:42 p.m. <br />At 6:57 p.m. a motion was made and seconded to exit executive session. <br />A roll call was conducted as follows: <br />Yes: Baker, Bullock, Kepple, Litten, Marx, Shachner <br />Nays: none <br />Committee of the Whole exited executive session and a motion was made and seconded to adopt <br />1 <br /> <br />
