Either the Director, Mayor, the Director of Law or their designee is hereby au- <br />thorized and directed to enter into agreements and execute all ancillary and related instruments <br />for the sale of said real property upon presentation of an acceptable offer as determined by the <br />Director. The Director shall communicate to City Council about the sale of said real property in a <br />timely manner. <br />Section 3. The Director specifically is authorized to negotiate and or make <br />counterpro-posals to any offer to purchase said real property, and shall, upon the close of the <br />transaction, report to Council the details of the sale. <br />Section 4. The Director shall make no representations or warranties concerning the condi- <br />tions of the property, including, but not limited to the property's environmental condition, me- <br />chanical systems, dry basements, foundations, structural integrity or compliance with code, zon- <br />ing or building requirements. <br />Section 5. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in <br />such formal action were in meetings open to the public in compliance with all legal <br />requirements. <br />Section 6. This ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the preamble <br />to this ordinance, and provided it receives the affirmative vote of at least two thirds of the mem- <br />bers of Council, this ordinance shall take effect and be in force immediately upon its adoption by <br />the Council and approval by the Mayor, or otherwise it shall take effect and be in force after the <br />earliest period allowed by law.
