In no <br />instance shall the height of the accessory dwelling unit exceed the height of the principal structure. <br />(9) The accessory dwelling unit must be reviewed and approved by the Architectural Board of <br />Review in accordance with any applicable requirements, standards, and guidelines. <br />(10) There shall be one designated off-street parking space on the lot on which the accessory dwelling <br />unit is located. <br />(11) The accessory dwelling unit must be separately addressed with the address posted in accordance <br />with Ohio Fire Code. <br />(12) An accessory dwelling unit cannot be separately conveyed for sale or purchase from the principal <br />structure on the lot. <br />(13) The minimum rental term for an accessory dwelling unit shall not be less than 60 days. <br />(14) No certificate of compliance or completion or permit to occupy an accessory dwelling unit shall <br />be issued until evidence is provided to the Planning & Development Director, or designee that a deed <br />restriction providing notice of the regulations of this Chapter and Section, on a form approved by the <br />Law Director, or designee, has been recorded on the lot with Cuyahoga County. <br />Section 16. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberation of the Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance with all legal requirements. <br />Section 17. This ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City and <br />for the usual daily operation of the City for the reasons set forth and defined in the preamble to <br />this ordinance, and provided it receives the affirmative vote of at least five (5) of members of <br />Council, this ordinance shall take effect and be in force immediately upon its adoption by the <br />Council and approval by the Mayor otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br />Adopted:11/20/2023 <br />Approved <br />DocuSigned by: <br />Jo�p 4itt, President of Council <br />-Uocignli�i: • <br />::0 <br />Maureen M.
