Where access cannot be attained, an alternate means to offer the same opportunities to persons with disabilities will be provided; and WHEREAS, the City is committed to providing training for staff on the requirements of the ADA and making accommodations for employees and residents with disabilities where appropriate and where such accommodations do not impose an undue burden; and WHEREAS, it is the goal of the City to make facilities for all services, programs, and activities fully accessible within 30 years, though this will be largely dependent on a number of economic factors and future changes to the ADA Standards for Accessible Design (ADASAD) or other unforeseen requirements that would necessitate additional improvements to City facilities; and WHEREAS, City staff and the ADA Task Force Members recommend City Council adopt the ADA SETP which will provide a framework for City staff as they continue to utilize the tools provided by the evaluation and transition plan; and WHEREAS, the City desires to accept the ADA SETP document as a guiding document for future decisions related to the City's responsibilities under Title II of the ADA; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments in that the City of Lakewood ADA SETP addresses the pressing issues of ADA accessibility; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The City of Lakewood ADA SETP document, in substantially the same form as is on file with the Clerk of Council, is hereby accepted. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of the Council and of any of its committees that resulted in such formal actions were in meetings open to the public in compliance with all legal requirements. Section 3. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble to this resolution, and provided it receives the affirmative vote of at least two thirds of the members of Council, this resolution shall take effect and be in force immediately upon its adoption by the
