Where access cannot be attained, an alternate means <br />to offer the same opportunities to persons with disabilities will be provided; and <br />WHEREAS, the City is committed to providing training for staff on the requirements of <br />the ADA and making accommodations for employees and residents with disabilities where <br />appropriate and where such accommodations do not impose an undue burden; and <br />WHEREAS, it is the goal of the City to make facilities for all services, programs, and <br />activities fully accessible within 30 years, though this will be largely dependent on a number of <br />economic factors and future changes to the ADA Standards for Accessible Design (ADASAD) or <br />other unforeseen requirements that would necessitate additional improvements to City facilities; <br />and <br />WHEREAS, City staff and the ADA Task Force Members recommend City Council adopt <br />the ADA SETP which will provide a framework for City staff as they continue to utilize the tools <br />provided by the evaluation and transition plan; and <br />WHEREAS, the City desires to accept the ADA SETP document as a guiding document <br />for future decisions related to the City's responsibilities under Title II of the ADA; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments in that the City of Lakewood ADA SETP addresses <br />the pressing issues of ADA accessibility; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The City of Lakewood ADA SETP document, in substantially the same form <br />as is on file with the Clerk of Council, is hereby accepted. <br />Section 2. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this Council, and <br />that all such deliberations of the Council and of any of its committees that resulted in such formal <br />actions were in meetings open to the public in compliance with all legal requirements. <br />Section 3. This resolution is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City and <br />for the usual daily operation of the City for the reasons set forth and defined in the preamble to <br />this resolution, and provided it receives the affirmative vote of at least two thirds of the members <br />of Council, this resolution shall take effect and be in force immediately upon its adoption by the <br />
