DocuSign Envelope ID: D733A3F0-EC57-49D6-A4C4-7A15E4E44C25 <br />referred to COW 12/4/23 <br />Please substitute for the original <br />RESOLUTIONNO. 2023-70 BY: Baker, Bullock, Litten, Marx, Rader, <br />Shachner <br />A RESOLUTION to take effect immediately provided it receives the vote of at least two <br />thirds of the members of Council, or otherwise to take effect at the earliest period allowed by <br />law, authorizing the Mayor and/or Director of Finance or Director of Law to allocate and expend <br />American Rescue Plan Act (ARPA) funds on certain high priority projects identified in the <br />Americans with Disabilities Act (ADA) Self -Evaluation and Transition Plan (SETP). <br />WHEREAS, Lakewood received a total of $47,219,575 of Coronavirus State and Local <br />Fiscal Recovery Funds (CSLFRF) through the ARPA, with the first fifty percent (50%) received <br />in 2021 and the second fifty percent (50%) received in 2022; and <br />WHEREAS, a $1 million tranche of these ARPA funds were set aside for projects and <br />initiatives prioritized by Lakewood City Council and intended to be allocated in either 2023 or <br />2024; and <br />WHEREAS, Lakewood City Council supports allocating $300,000 of these funds to be <br />spent on certain high priority projects identified in the Americans with Disabilities Act (ADA) <br />Self -Evaluation and Transition Plan so that the City may be more accessible for all individuals <br />and to make progress toward compliance with the Americans with Disabilities Act; and, <br />WHEREAS, because the Administration shares an interest in this project, the Mayor will <br />contribute $700,000 from the City's General Fund, ARPA funds, or other allowable source; and, <br />WHEREAS, as set forth in Section 2. 12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public peace, property, health and safety, and to <br />provide for the usual daily operation of municipal departments in order to fund these projects in a <br />timely manner; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. That $300,000 shall be allocated from City Council's $1 million tranche of American <br />Rescue Plan Act (ARPA) funds and spent on certain high priority projects identified in the <br />Americans with Disabilities Act (ADA) Self -Evaluation and Transition Plan (SETP). <br />Section 2. That $700,000 of the City's funds shall be allocated and spent on the above -mentioned <br />projects. <br />Section 3. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this resolution were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />
