Revised Code. He stated that the version shared with the committee demonstrates the progress <br />made toward that end but needs approximately 3 more weeks of work. He committed to bringing <br />the City Prosecutor to the next committee discussion on the ordinance and to having a polished <br />version ready to present at that time. <br />Chief Assistant Director Swallow explained that the Law Department’s version of Ordinance 40- <br />2023 seeks to accomplish the following: <br />Includes a definition of “enclosure,” which is referenced as an enclosure within which six <br />allowed marijuana plants may be grown, but not defined in ORC. <br />Clarifies that marijuana use under age 21 is prohibited in the Lakewood Codified <br />Ordinances. <br />Clarifies that driving while under the influence of marijuana is prohibited. <br />Adds a violation for cultivation of marijuana above and beyond the allowed six plants. <br />Chair Baker encouraged committee members to review all pertinent materials and come prepared <br />with questions for the next hearing. He expressed appreciation for the Administration’s <br />thoughtful approach. <br />Councilmember Bullock remarked that that while he intends for the City to comply with state <br />law, he welcomed additional committee discussion regarding areas where municipalities have <br />discretion. He questioned how the new law will change norms and acceptable behaviors and the <br />role of Council in influencing those. For example, he questioned if marijuana will now be <br />acceptable at parks and street festivals in the City. <br />Committee members responded that the City’s existing laws on public intoxication and no <br />smoking in parks can address many concerns. <br />The committee and the Law Department had additional exchanges regarding the differences and <br />similarities between the two versions of Ordinance 40-2023. <br />Councilmember Shachner expressed enthusiasm for moving forward together on this issue. <br />It was clarified that the Law Department has communicated with the Police Department about <br />what sections of the Code can and cannot be enforced at this time, due to the changes in ORC. <br />Soon, the Code will be updated to match those practices. <br />The committee and the Law Department made concluding remarks, noting that there will be <br />more than one way to accomplish the same goals. Both expressed commitment to a collaborative <br />process moving forward. <br />Motion by Councilmember Baker, seconded by Councilmember Shachner to defer Ordinance 40- <br />2023. All members in favor. Ordinance 40-2023 deferred. <br />Public Safety Committee adjourned at 6:36 p.m. <br />2 <br /> <br />
