Either the Director, Mayor, the Director of Law or their designee is hereby au- <br />thorized and directed to enter into agreements and execute all ancillary and related instruments <br />for the sale of said real property upon presentation of an acceptable offer as determined by the <br />Director. As it relates to Permanent Parcel Numbers 312-24-024 and 313-14-007 ("Com- <br />mercial Properties"), the Director shall include the Council President (or his or her design- <br />ee) and the Ward 2 Councilperson in the review, consideration, deliberation, scoring (if ap- <br />plicable), and possible approval of any of the offers associated with the Commercial Prop- <br />erties. <br />Section 4. The Director specifically is authorized to negotiate and or make counterpro- <br />posals to any offer to purchase said real property, and shall, upon the close of the transaction, <br />report to Council the details of the sale. <br />Section 5. The Director shall make no representations or warranties concerning the condi- <br />tions of the property, including, but not limited to the property's environmental condition, me- <br />chanical systems, dry basements, foundations, structural integrity or compliance with code, zon- <br />ing or building requirements. <br />Section 6. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />Section 7. This ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the preamble <br />to this ordinance, and provided it receives the affirmative vote of at least two thirds of the mem- <br />bers of Council, this ordinance shall take effect and be in force immediately upon its adoption by <br />the Council and approval by the Mayor, or otherwise it shall take effect and be in force after the <br />earliest period allowed by law. <br />Adopted: <br />4/ 1 /2024 <br />Approved: ql3l i <br />DocuSigned by: <br />Sarah Kepple, President of Council <br />DocuSigned by: <br />Maureen M.
