<br />Stevens <br /> <br />Mr. <br /> <br />by <br /> <br />1761 <br /> <br />ORDINANCE No. <br /> <br />cutting of noXious weeds in the <br /> <br />AN ORDINA.NCE proViding for the <br />City of Lakevrood. <br /> <br />OF <br /> <br />STATE <br /> <br />CITY OF LAKNNOOD, <br /> <br />THE <br /> <br />ORDAINED BY THE COUNCIL OF <br /> <br />BE IT <br />OllO: <br /> <br />Section 1: Upon written information that noxious weeds are <br />growing on lanðs in a municipality, and are about to spread or mature <br />seeds, the council of such municipality shall cause a ~itten notice to <br />be served upon the owner, lèssee, agent or tenant having charge of such <br />land notifying him that said noxious weeds are growing on such lands <br />and that they must be cut and destroyed within .five days after the service <br />of such notice. If such owner o~ other pèrson having charge of such <br />lands is a non-resident whose address is known, such notice shall be sent <br />to his address by registered mail; if the address of such owner is unknown, <br />it shall be .sufficient to publish such notice once in a newspaper of <br />gneral circulatiòn iÍl the county. <br /> <br />, Section 2:. Any police officer, clerk of council or his deputy, <br />may make service and return of the notice provided for the next preceding <br />section and the fees therefor shall be the same as are allowed for service <br />and return of summons in civil cases before a magistrate. <br /> <br />Section 3: If the owner, lessee, agent or tenant having charge <br />of the lands m.entioned in section one herein, fails to comply with such <br />notice, the council of such municipality shall cause said noxious weeds to <br />be cut and destroyed and may employ the necessary labor to carry out the <br />provisions of this section. All expenses incurred shall, when approved <br />by the council, be paid out of any money in the treasury of the municipality <br />not othenYise appropriated. <br /> <br />Section 4: The council shall make a written return to the county <br />auditor of their county of their action under the next three preceding sections <br />with a statemènt of the charges for their services, the amount paid for the <br />performing of such labor and the fees of the officers who made the service of <br />the notiée and return and a proper description of the premises.
