ORDINANCE NO. 1820 By Mrs. Knirk ~ <br /> <br />AN ORDINANCE to provide for the construction of sewer and water c~nnections <br />of vitrified sewer pipe and lead water pipe respectively, in Archdale Avenue <br />from L~rchmont Avenue to Riverside Road and levying and assessing a special <br />tax to pay the cost and expense thereof, and'authorizing the Mayor and Direct <br />of ~lnance to issue notes in the sum of $1,092.00, in anticipation of the <br />collection of said special tax to provide a fund for the payment of the por- <br />tion of the cost and expense of said improvement for which said special tax <br />is levied. <br /> <br />WHEREAS, the Director of Public Works cf the City cf Lakewood, in view cf <br />contemplated street improvements and as a sanitary regulation has deemed it <br />necessary and conducive to the public health, convenience, or welfare, and <br />has determined that sewer and water scnneotions shall be constructed in <br />Archdale Avenue from Larchmont Avenue to Riverside Road, and <br /> <br />WHEREAS, said Director of Public Works has caused written notice of his <br />determination thereof tc be given to the owner of each lot or parcel cf <br />land to which such connections are to be made, which notice stated the number <br />and character of connections required0 and was served by a person designated <br />by the Director of Public Works in the manner provided for the service or <br />summons in civil actions, and non-residents of the City, er persons who could <br />not be found were served by publication once in a newspaper of general cir- <br />culation in the municipality, which notice stated the time within which such <br />o~nnections should be made, to-wit: thirty days after delivery thereof, and <br /> <br />WHEREAS, a large number of said connections have not been constructed with- <br />in the time stated, and it is necessary that said connections be made with- <br />cut delay, and the cost of Said connections has been estimated by the <br />Director of Public Works as $1,092.00, and <br /> <br />~tEREAS, an mmergency exists for the immediate preservation of the public <br />health, property and safety, arising out of the necessity of the construction <br />of said connections without delay. <br /> <br />NOW, THEREFORE BE IT ORDAINED by the Council of the City of Lakewood, State <br />of Ohio, three-fourths of all members, thereof concurring:- <br /> <br />Section 1: That in view of the facts setforth in the foregoing preamble, <br />the Director of Public Works be and he is hereby authorized, and direct&d~ <br />to enter into contract_in the manner provided by law to make and have made <br />sewer and water connections, of vitrified sewer pipe and lead water pipe <br />respectively, in Archdale Avenue from Larchmont Avenue to Riverside Road <br />in accordamce with plans, specifications and estimates on file in the office <br />of the Director of Public Works and the notices and proceedings heretofore <br />given and had pertaining to said sewer and water connections, and said <br />plans, specifications, estimates, notices and proceedings are hereby approved <br /> <br />Section 2: That for the purpose of paying the cost of said connections <br />there shall be and there is hereby levied and assessed a special tax upon <br />the several lots and parcels of land for which connections are made. Said <br />assessment shall be certified and collected as other assessments for street <br />improvements. <br /> <br />Section 3: That the owners of the several lots and parcels of land so <br />asseszed shall pay the amounts from them severally due as shown by tl~e <br />repprt cf said Director of Public Works, to the Director of Finance on or <br />before thirty days from the dste of the passage of this ordinance, at their <br />option, and in default thereof said special assessment, with interest at <br />the rate of not to exceed six per cent (6%) per annum, upon deferred pay- <br />mentS, shall be payable to the County Treasurer in two equal installments <br />with the regular taxes of 1922 and 1923. <br /> <br /> <br />
