ORDINANCE NO, 1821 ~YMrs. Knirk AN ORDINANCE to provide for the construction of sewer nfld water conneotiom of vi~rified sewer pipe and lead water ~lpe respectively, in Arden Avenue from Alger Road to Andmar Avenue. and levying and assessing a special tax te pay the cost and expense %hereof, and authorising the Mayor and Director of Finance to issue notes in the sum of $1.180.00, in anticipation of the collection of said special tax to provide a fund for the payment of the portion of the cost and expense of s~id improvement for which said special tax is levied. WHER~A~, the Director of l~Ablic Works of the City of Lakewood, in view of contemplated st~'eet improvements and as a sanitary regulation deemed it necessary and conducive to the public health, convenience, or welfare, and has determined that sewer and water connections shall be constructed in Arden Avenue from Alger Road to Andmar Avenue, and Wt~AS, said Director of Public Works llas caused written notice of his determination thereof to be given to the owner of each let or parcel of land to which such connections are tO be made, which notice stated the number a~d character of connections required, and was served loy a person designated by the Direotc~r of Public Works in the manner provided for the service or summons in civil actions, and non-residents cf the City, or persons who could not be found were served by Dublicstion once in a newspaper of general circulation in the municipality, which notice stated the time within which such connections should be made, to-wit; thirty dmys after delivery thereof, and ~I~RFAG, a large number of said connections have not been constructed within the time stated, and it is nece:~eary that said connections be made without delay, and the cost of said connections h~s bean estimated by the Director of Public Works as $1,180.00, a~d ~.~R2Ao, an emergency exists for the immediate preservation of the public health, property and safety, arising out of the necessity of the construc- tion of said conneotion~ without delay, NO~, THE~!~FOR~ B~ IT' OHDAINED by the Council of the City of L~ewood. State of Ohio, three-fourths of all members thereof concurring: Section 1: That in view of the facts seOfor%h in the foregoing preamble, the Director of Public Works be, and he is hereby authorized and directed to enter into contract in the manner provided by law to make and have made sewer and water connections, of vitrified sewer pipe and lead water pipe respectively, in Arden AVenue from A~lger Road tc Andm~r Avenue, in accordance with plans, s~ecificatione and estimates on file in the office of the Director of Public Works add the notices and proceedings heretofore given and had pertaining to said sewer and water connections, s, nd said plans, spesifications, estimates, notices and proceedings are hereby approved. section 2: That for the purpose of paying the cost of said connections there shall be and there is hereby levied and assessed ~, special tax upon the several lots and p~roels of land for which connections ~re made, Said assessmen~ shall ~e certified and collected as other assessments for street improvements. Section ~: T~t the owners of the several lots and parcels of ln~d so assessed shall pay the amounts from them severally due as shown by the report of said DireCtor of Public Works, to the Director of Finance on or before thrity days from the date of the passage of thl~ ordinance, at their o~tion, and in default thereof said special assessment, with interest at the rate of not to exceed mix per cent (6%) per annu~, upon deferred payments, shall be payable to the County Treasurer in two equal installments with the regular taxes of 1922 and 192].
