<br />AN ORDINANCE to provide for the construction of se~or and water connections
<br />Of vitrified sewer pipe and lead water pipe respectively, in Concord Drive
<br />from Riverway Drive to Delaware Avenue and levying and assessing a special
<br />tax tO pay the cost and expense thereof, and authorizing the Mayor and
<br />Director of Finance to issue notes in the sum of $1,~80.O0 in anticipation
<br />of the collection ef said special tax to provide a fund for the payment
<br />ef the portion of the cost and expense of said improvement for which said
<br />special tax is levied.

<br />Wt~REAB, the Director of Public Works of the City of Lakewocd, in view of
<br />contemplated street improvements and as a Sanitary regulation has deemed
<br />it necessary and conducive to the public health, convenience, or welfare
<br />and ~s determined that sewer and water connections shall be oonstreoted
<br />in Concord Drive from Riverway Drive to Delaware Avenue, ~nd
<br />
<br />~HEREAS, said Director of Public Works has caused written notice of his
<br />determination thereof to be given te the owners of each lot or pa. reel of
<br />land to which such connections are to be made,which notice stated the
<br />number and character of connections required, and was served by a person
<br />designated by the Director of Public Works in the manner provided for
<br />the service or summons, in civil action~, and non-residents of the City,
<br />er persons who could not be found were served ~y publication once in a
<br />newspaper of general circulation in the municipality, which notice stated
<br />the time within which sush connections should be made, to-wit$ thirty
<br />days after delivery thereof, and
<br />
<br />~HEREA$, a large number of said connections have not been constructed
<br />within the time stated, and it is necessary that said connections be made
<br />without delay, and the eos~ of said connections has been estimated by
<br />the Director of Public Works as $1,~80.00, and
<br />
<br />W;-~REAS, an emergency exists for the immediate preservation of the oublie
<br />health, property and safety, arising out of the necessity of the con~ruc-
<br />%ion of said conneetion~ without delay.

<br />NOW, T~EREFORE BE IT ORD^IN'~D by the Council of the City of L~kewood,
<br />~tate of Ohio, three-~our~hs of all members thereof concurring~
<br />
<br />Section X~ That in view of the f~cts setforth in the foregoing preamble,
<br />the Director of Public Works be, and he is hereby authorized, and directed
<br />to enter into contract in the manner provided by l~w to make and have made
<br />sewer and water connections, of vitrified sewer pipe and lead water pipe
<br />respectively, in Concord Drive from Riverway Drive to Delwware Avenue, in
<br />accordance with plans, speciftc~tions and estim~tes on ftl~ in the office
<br />of the Director of Public Works and the notices and proceedings heretofore
<br />given and ~md ~ertaining to said sewer and water connec~ion~, and said
<br />plans, specifications, estimates, notices and proceedings are hereby
<br />approved.

<br />Section 2: That for the purpose of paying the Cost ef maid connections
<br />there shall be and there is hereby levied and assessed a special tax
<br />upon the several lots and parcels of land for which connections are m~de,
<br />Said assessments shall be certified and collected as other assessments
<br />for street improvements.
<br />
<br />Section ~ Tha~ the owners of the s~veral lots and p~rcels of land so
<br />assessed shall pay the amounts from them severally due as shown by the
<br />report of said Director of Public Works, to the Directsr ,f Finance cn
<br />or before thirty days from the date of the passage of this ordinance.
<br />at their option, and in default thereof said special assessment, with
<br />interest at the rate of not to exceed six per cent (6%) per armum, upon
<br />deferred p~yments, shall he payable tc the County' Treasurer in two equal
<br />installments with the regular taxes of 1922 and 1923,
