C ORDINANCENO~ 182~ SY Mr. Gormsen AN ORDINANCE to provide for the construction of sewer and water connections cf vitrified sewer pipe and lead water pipe respectively, in Niagara Drive from Hilliard Head to Lakewood Heights Boulevard and levying and assessing a special tax to pay the cost and expense thereof, and authsriz~ng the Mayor ~nd Director of Finance to ~ssue notes xn the sum of $1,760.00 in antieipation of the collection of said special tax to provide a fund for the payment of the portion of the cost and expense of said improvement for which said special ta~ is levied. ~H~[t,IAS, the Director of Public Works of the City of ~akewood, in view. of comtempl~ted street improvements and as a ssnitary regulation has deemed it necessary and conducive to the public health, convenience, or welfare, and has determined that sewer and water connections sh~!l be constructed in ~iagara Drive from Hilliard Road to Lakew~od Heights Boulevard, ~nd ~}~R~S, ~aid Director of ?ublic ~crks has caused written notice of his determin~tion thereof to be given to the owner of each lot or p~rcel cf land to which such connections are to be made, which notice stated the number and c~.racter Of connectionm required, and w~s served by a person designated by the Director of Public 'ffcrks in the manner provided for the service or summons in civil actions, ~nd non-residents of the City, er persons who could not be found were served by public~tion once in a newspaper of general circulation in the ~unicip~lity, which notice stated the time within Which such connections should be made, to-wit~ thirty !i~ays after delivery thereof, and ~HER~AS, a large number of s~id connections have not been constructed within the time stated, and it is necessary that s2id connections be made without delay, ~nd the cost of said connections h~,s been esti~ted by the D£reetor of Public ~orks ~s $1,760.00. and W~U~H2AS, an emergency exists for the immediate preservation of the public health, property and safety, ariGing est of the neeessity of the construc- tion of said connections without BO~, T~I~FO~ B~ IT ORDAIneD By th, council of the City of Lakswood, ~tate of Ohio, three-fourths of all members thereof ccncurring~ Section 12 That in view of the f~cts setforth in the ~oregoin~ preamble, the Director of Public Works Be, and he is hereby authorized, and directed to enter into contract in the manner provided bylaw to m~ke and have ~de se~er ~nd water connections, cf vitrified sewer pipe and lead w~ter pipe respectively, in Niagmra Drive from Nillis. rd Road to Lakewood Heights Boulevard in accordance with plans, specifications and estimates on file in the office of the Director of Public Works ~nd the nsticea and proceed- ings heretofore given and ~d pertainin~ to s~ld sewer ~nd water connection~ and maid plans, speoific~tIons, estimates, notices and proceedings ~re hereby approved. Section 2~ That for th~ purpose of paying the cost oi' s~id connections there shall be and there is hereby levied and assessed ~ special tax upon the several lots and parcels o£ land for which connections ~re m~de. amid assessment shall be certified and collected a~ other ~ssesmm~nts for street improvements. Section 31 That the owners of the several lots and parcels of land so assessed shall pay the amounts from them s~verally due e~ shown By the report of s~id Director of Public Works, to the Director of Finance on or ~efore thirty-day:~ from the date cf the pas'~a~e Of this ordinance, at their option, and in default thereof said special assessment, with interest at the rate of not to exceed six Der cent (65) per annum, upon deferred payments, shall be payable to the Oounty Treasurer in two equal installm~n~s with the re&~l~r taxes of 1~22 and 1~2].
